There’s the “public” virtue of an “abandoned” roadway and subsequent ownership. Also, ACLU would/has argued even with private ownership, it’s a public venue in nature.

@VitalVegas There are tunnels all over the valley. We lived near the 215 & Windmill and there is a giant entry there as well as by Silverado HS. They just moved them under your homes and schools rather than under the tourists.
