●The Charity Commissioner of Maharashtra has revoked the permission granted for sale of HND Jain Hostel land to Gokhale Landmarks LLP.
●This is not withdrawal. This is a LEGAL CANCELLATION under Section 36(2)
• The sanction order dated 04-04-2025 under Section 36 is revoked
• Sale Deed & Power of Attorney dated 08-10-2025 must be canceled
• Trust must refund the entire sale consideration (minus TDS) to Gokhale Landmarks
• Trust must update PTR records after cancellation
●This is now a binding legal order
This is a precedent-setting order under the Bombay Public Trusts Act, 1950. Section 36(2) is exercised only when there is:
• Lack of transparency
• Community interest at risk
• Need to protect donor intent & trust purpose
●The Commissioner clearly found grounds to intervene. This is a moral victory, too. A message to all trusts that operate in the name of Dharma:
Community assets are not private real estate. they are sacred responsibility.

बुडत्याचा पाय खोलात म्हणतात ते याला!
ज्या पतसंस्थांनी गोखले लँडमार्क्सला मॉडल कॉलनीतील जमीन खरेदीसाठी ७० कोटी रुपये कर्ज दिले, त्या संस्थांनी काल अचानक गोखले यांनी "कर्ज फेडल्यामुळे" सदर मिळकतीचे रिकनव्हेन्स डीडकेले आहे.

हे सगळं आश्चर्यकारक आहे!

ज्या पतसंस्थांनी हा व्यवहार केला, त्यांच्या व्यवहाराच्या सचोटीवर आधीच गंभीर शंका निर्माण झाल्या होत्या. त्यांच्या पत्रांवरून दिसतं होतं की हा व्यवहार कुणाच्या तरी दबावाखाली, नियमांचं उल्लंघन करून, आणि कागदपत्रे न पाहताचकरण्यात आला आहे.

आधी बँकांनी दुय्यम निबंधकांना पत्र लिहिलं होतं की:

"मिळकती संदर्भात दिलेलं कर्ज आता बोजामुक्त करा!"

पण दुय्यम निबंधकांचा बोजा चढवण्याशी किंवा काढण्याशी काहीही संबंध नाही! त्यांना फक्त नोंदणीचा अधिकारआहे, आणि दस्त रद्द करण्याचा अधिकार फक्त न्यायालयाला असतो.ही बाब उघडकीस आल्यानंतर प्रकरणावर पडदा पडल्यासारखं दाखवण्यासाठी रीकन्वेयन्स डीड करण्यात आलं आहे. पण या डीडमुळे उलट व्यवहारातील दबाव आणि गोंधळाची पुष्टीहोते.

पूर्वी सांगितलं गेलं होतं की कर्ज हे गहाण कर्ज (Mortgage Loan) आहे. पण गहाणखतामध्येच व्यावसायिक कर्ज (Professional Loan) असल्याचंही नमूद होतं !

आता कर्ज फेडल्याचं सांगितलं जात आहे.

ही सगळी बनवाबनवी कुणाला वाचवण्यासाठीचालली आहे का?

पुण्यातील जैन ट्रस्टच्या मालमत्ता व्यवहारातील अनियमितता आणि केंद्रीय राज्यमंत्री श्री. मुरलीधर मोहोळ यांच्या सहभागाबाबत चौकशी करून कारवाईची विनंती मी आज मा. पंतप्रधान नरेंद्र मोदी यांच्याकडे केली आहे.
पुण्यातील हिराचंद नेमचंद दोशी मेमोरियल ट्रस्टच्या सुमारे ३ एकर जमिनीचा व्यवहार गोखले लँडमार्क्स एलएलपी या कंपनीने कायदेशीर आणि प्रक्रियात्मक नियमांचे उल्लंघन करून केला आहे. या व्यवहारासाठी बुलढाणा अर्बन को-ऑप क्रेडिट सोसायटी (महाराष्ट्र) आणि श्री बिरेश्वर को-ऑप क्रेडिट सोसायटी (कर्नाटक) यांनी नियमांचे उल्लंघन करून मोठ्या रकमेचे कर्ज दिले. या संस्थांनी कर्ज देताना आवश्यक तपासणी केली नाही, ज्यामुळे त्यांच्यावर बाह्य प्रभाव किंवा दबाव असल्याचा संशय निर्माण होतो.
केंद्रीय सहकार राज्यमंत्री श्री. मुरलीधर मोहोळ यांच्याकडे या मल्टी-स्टेट को-ऑप सोसायटींच्या प्रशासकीय देखरेखीची जबाबदारी आहे. तसेच त्यांनी गोखले लँडमार्क्स एलएलपीच्या “गोखले बिझनेस बे” प्रकल्पाला प्रोत्साहन दिले असून, त्यांचे या कंपनीच्या भागीदारांशी जवळचे संबंध असल्याचे जाहीर आहे. त्यामुळे दोन्ही बाजूने त्यांचा या प्रकरणाशी संबध असल्याचे दिसून येते.
मोहोळ यांच्या निवडणूक प्रतिज्ञापत्रातून असे दिसते की ते गोखले इस्टेट्स एलएलपीमध्ये ५०% भागीदार होते, जी गोखले लँडमार्क्सशी संबंधित आहे. महाराष्ट्र रिअल इस्टेट नियामक प्राधिकरणाने (महारेरा) गोखले लँडमार्क्सवर रेरा कायद्याचे उल्लंघन केल्याबद्दल कारवाई केली आहे. “गोखले बिझनेस बे” आणि “तेजकुंज” प्रकल्पांसाठी एकच बँक खाते वापरल्याने आणि ७०% निधी स्वतंत्र ठेवण्याच्या नियमाचे पालन न केल्याने प्रकल्प नोंदणी रद्द, बँक खाती गोठवली आणि विक्रीवर बंदी घालण्यात आली आहे.या उल्लंघनांनंतरही सहकारी संस्थांनी सुमारे ₹७० कोटींचे कर्ज मंजूर केले आणि नंतर तारण हक्क सोडले, त्यामुळे या प्रकरणातील गैरव्यवहारांबाबत संशय वाढतो.
श्री. मोहोळ यांनी याप्रकरणी कोणतीही कारवाई न करता "आपला या प्रकरणाशी काही संबध नाही' असे म्हणत स्वतःला दूर ठेवले आहे.खरेतर या प्रकरणी लोकप्रतिनिधी आणि मंत्री या नात्याने त्यांनी आवर्जून लक्ष घालून कारवाई केली असती तर ते जास्त संयुक्तिक दिसले असते. तसे ना केल्याने या प्रकरणातील त्यांचा कॉन्फ्लिक्ट ऑफ इंटरेस्ट दिसून येतो आणि सहकारी प्रशासनावरील विश्वास कमी होतो.
वरील बाबींचा विचार करून
1.जैन ट्रस्टच्या जमीन व्यवहाराची सखोल चौकशी करावी.
2.गोखले लँडमार्क्स एलएलपी, दोन्ही सहकारी संस्था आणि संबंधित अधिकाऱ्यांच्या भूमिकेची तपासणी करावी.
3.श्री. मुरलीधर मोहोळ यांच्या सहभागाची चौकशी करून हितसंबंधांचा गैरवापराबाबत त्यांच्यावर कारवाई करावी.

आतापर्यंत राज्यातील हिंदू देवस्थानांच्या आणि मंदिरांच्या जमिनी सत्तारूढ पक्षाच्या आमदारांनी हडप केल्याचे आम्ही वारंवार निदर्शनास आणून दिले होते. आता त्यामध्ये पुण्यातील जैन समाजाच्या मंदिराच्या जागेचाही समावेश झाला आहे.

पुण्यात मॅाडेल काॅलनी येथील जैन समाजाची जागा आहे. ज्या ठिकाणी जैन समाजाच्या विद्यार्थ्यांचे वसतिगृह आहे व जैन समाजाचे जुने मंदिर देखिल आहे. परंतु ते मंदिर जागेवर न दाखवता, सर्व कायदे व नियम धाब्यावर बसवून ही जमीन हडपली असून २३० कोटींचा व्यवहार केला गेला आहे.

विशेष म्हणजे

सरकारी कार्यालयातून केवळ एका दिवसात या व्यवहाराला मंजूरी मिळते.

सहकारी बँक ७० कोटींचे कर्ज विकासकाला एका दिवसात मंजूर करते.

जैन समाजाच्या जागेच्या लिलावासाठी जे विकासक येतात ते तिघेपण सत्तारूढ पक्षातील एका सदस्याचे व्यावसायिक भागिदार आहेत.

आज जैन समाजाने या प्रकरणावर मोठा मोर्चा पुणे जिल्हाधिकारी कार्यालयावर काढला होता. या लढ्यासाठी आमचा जैन धर्मिंयांना संपूर्ण पाठिंबा आहे तर आहेच पण आम्ही या लढ्यात जैन धर्मिंयांसोबत आहोत. सर्व कामांची सखोल चौकशी करून या प्रकल्पांच्या कामावर स्थगिती आणावी.

एकीकडे धर्माच्या नावावर लोकांमध्ये वितुष्ट निर्माण करून त्यांचं लक्ष विचलित करायचे आणि दुसरीकडे धर्मांच्या हक्काच्या जमिनी लाटायच्या, हा खेळ आम्ही महाराष्ट्रात चालू देणार नाही.
