South Africa only recognises three main legal marriage types:
Civil Marriages (heterosexual, governed by the Marriage Act)
Civil Unions (same-sex & opposite-sex, under the Civil Union Act, offering equal rights)
Customary Marriages (negotiated by indigenous laws, must be registered).
Unfortunately, South African law does not recognise "common-law marriage", so unmarried couples who live together have no automatic legal rights or protections, regardless of how long they cohabit.
This means no automatic inheritance, no spousal maintenance after separation, and no automatic sharing of property. Ownership of assets generally follows the legal title, so if something is registered in one partner's name, the other has no automatic claim even if they contributed financially.
To protect themselves, cohabiting couples should take proactive steps, such as draft a comprehensive cohabitation agreement (ideally commissioned) to regulate property, finances, and what happens on breakup or death; each make a valid will naming their partner as beneficiary; and register joint assets (like property) in both names.
While courts may sometimes recognise an implied universal partnership, this is rare, difficult to prove, and far less reliable than a properly drafted written agreement. Consulting a family law attorney is strongly recommended.
I know many women who have been left destitute after long-term, non-marital relationships - often involving children - have fallen apart.
Maybe @ThuliMadonsela3
might be the perfect person to campaign for a change in our law?
R3.2 billion Afrikaans Akademia campus underway in Pretoria
Solidarity Movement, in partnership with AfriForum and real estate developer Kanton, has begun construction on a new R3.2 billion Afrikaans Akademia campus outside Pretoria.
The project was announced in August 2024, with construction officially starting on August 11, 2025.
It is one of the largest private-sector investments in South Africa in recent years and aims to provide a world-class residential campus for 5,000 undergraduate and 1,500 postgraduate students, with completion expected by 2028.
@MDNnewss One thing about these guys, they will make things happen! So Iโm legit happy for them.
In SA we have a huge number of black multi millionaires, but they wonโt do such projects and people will still complain when the other race does it.
I actually have written on it. In practical terms, it means that if youโre married out of community of property without accrual and the marriage ends in a divorce/death, a court can transfer assets or part thereof from the financially stronger spouse to the financially weaker spouse. The financially weaker spouse who asks for the redistribution order must prove that they contributed during the marriage to the maintenance or the growth of the other spouse's estate, for example, through the rendering of services and saving expenses.
