“The Kelsey Fitzsimmons story still remains one of the saddest cases out there. Today marks 237 days since she last held or saw her baby, all because of a one-sided ex parte order filed by a father claiming fear.
To refresh everyone’s memory, here’s a timeline of what happened from June 29th leading up to the incident — and exactly why everyone should stand with Kelsey and join Justice for Kelsey Fitzsimmons – Official Group
June 29th
After a series of text messages throughout the day, Justin showed up at Kelsey’s home while she was there with their baby. Following a disagreement from the weekend at a bachelorette party, he decided he wanted to pick up some guns and personal belongings. He came into the home, gathered what he wanted, and left without any incident. He did not attempt to take the baby. There was no emergency, no police escort, and no confrontation. He left calmly, because in that moment he knew the baby was not in danger.
June 30th (Justin’s claim per court documents)
He went to court and sought an emergency abuse prevention order, claiming he was in fear for his life and the baby’s safety. The order was granted, giving him sole custody of the minor child and ordering Kelsey to have no contact with either him or her baby. Conveniently, he left out that he had contacted Kelsey earlier that same day asking her to go for a walk in the park, and that just the day before, he had gone to her home without hesitation to pick up guns and personal belongings.
June 30th (What actually occurred that same day)
Kelsey attended her annual CPR training at the North Andover Police Department. She had her baby with her, coworkers interacted with the baby, and everything was normal. She was even walked out to her car afterward. There were no signs of danger, no emergency, and no intervention.
That same day, Justin contacted Kelsey and asked her to meet for a walk at North Andover Commons to talk about their relationship, their future, and what was best for their child. She agreed. She showed up. He never did. Instead, while she was waiting for him, he was at the courthouse filing the emergency order behind her back. After waiting and realizing he wasn’t coming, she returned home to feed her baby.
While she was feeding her baby, Officer Sean Daley, Officer Patrick Noonan, and Officer Timothy Houston of the North Andover Police Department arrived at her home. She answered the door. She was told she had to hand over her baby. She began gathering her belongings and preparing, while officers escorted her upstairs. Around the same time, Justin arrived at the home, and her mother arrived separately.
Kelsey specifically asked the officers to keep Justin away from her during one of the most traumatic moments of her life. Yet he was still allowed inside the home while her baby was being taken from her. Why he was allowed to be present during something that emotional and devastating is beyond me. Officer Houston then left the upstairs area and went toward the basement to deal with Justin and keep him far, far away. From that point forward, the accounts of what happened begin to differ significantly.
Officer Sean Daley Account
Daley stated he remained downstairs with Kelsey’s mother, Justin, and Officer Houston. He reported hearing Officer Noonan yell, “Kelsey don’t do it, Kelsey don’t do it,” immediately followed by two gunshots. This aligns with someone in crisis rather then a homicidal person.
Justin’s account
In probate court filings, Justin stated he was in the garage at the time, heard yelling followed by two gunshots, and ran outside through the garage in fear. However, the garage is one floor down from where Lt. Daley stated he was positioned on the first floor with Kelsey’s mother and Officer Houston. Daley’s account places Justin inside the home with them, not alone in the garage, which directly conflicts with Justin’s version of events.
There needs to be law changes in Massachusetts and any other state where a child can be taken away from one parent simply because an RO is served.
There needs to be a proper procedure to allow for a temporary joint custody order to be in place until a proper child custody hearing can occur.

“Denied as moot” 🟰 there is no need for the motion to be heard, because the defense will have what they asked for: a new judge to preside over this matter. ⚖️
This is the court’s way of preventing an evidentiary hearing that would be excruciatingly embarrassing for Judge McCarthy-Neyman, and perhaps more important actors.
