Red Points is acutely aware of its legal vulnerability regarding unverified, automated enforcement. In ***Unlimited Cellular, Inc. v. Red Points Solutions SL* (S.D.N.Y.)**, the United States District Court explicitly denied Red Points’ motion to dismiss claims of **Defamation** and **False Advertisement** arising from its practice of submitting automated infringement reports without proper manual verification and failing to promptly retract false positives.

Under United States copyright law (**17 U.S.C. § 512(f)**), it is illegal to knowingly and materially misrepresent that content is infringing. The law provides clear statutory mechanisms for creators to recover damages—including direct loss of revenue, operational damages, and attorney's fees—resulting from material misrepresentation and bad-faith DMCA takedowns.

@Sayedquraish @canva Agreed. And the only consequences are the ones (the creators) who got hit with a false strike. Now we have to go through the efforts to get it fixed.

@sharondaniel91 @canva The most frustrating part is that you can't even appeal, get clarification or successfully contact anyone. I CC'd my Canvassador manager on two occasions plus the community team as a whole. Crickets 🦗

@canva @Yolo_view Maybe also look into the company you use, Red Points' falsely executing false copyright infringements on Canvassadors, causing measurable disruption to creators' livelihoods. This behavior falls squarely within the pattern of reckless, unverified automation.
