NEW: Former BYU baseball player sentenced after being accused of s*xually assaulting a girl for 5 years, starting when she was just 7 years old.

The girl, now 15, says the abuse from now 22-year-old Candon Dahle started when she was 7 and lasted until she was 12.

"My earliest memory of the abuse is 7 years old, but I know he was touching me before that. Almost every time we were together, Candon was touching me under my clothes..."

"Some memories are so damaging, because it was me holding in cries of pain while Candon was pleasured."

"I was just 11 years old when he covered my mouth because he didn’t want the family close by to know what he was doing."

"You forced me to keep your secret for seven years. I sat through your baseball games, I watched the world cheer for you."

"I watched you achieve every church standing and be celebrated, all while I screamed inside because I knew the truth."

Dahle was sentenced to just 180 days in local jail in Idaho, 8 years of probation, just $2600 in fines, and 200 hours of community service.

He also does not have to register as a s*x offender thanks to the plea deal.

What a pathetic sentence.

Let this be a warning that in Oregon, if a woman has consumed alcohol, she may legally be considered unable to give consent, even if she initiates sex and willingly participates. You may believe what you’re doing is mutual, but the law may see it differently.

This sentencing has broken me. Ben McLemore has been my whole heart, and I know his kind, gentle nature doesn’t deserve such a harsh accusation. We’ve shared life’s highs and lows, and I’ve seen his true character. That’s why this outcome hurts so deeply.

In Ben McLemore’s situation, Oregon law says sex without consent includes being too drunk, but both were heavily intoxicated. There was no force, no threat. It’s heartbreaking that her regret can turn into a rape charge, especially when the situation was mutual.

I was in that courtroom every day. I sat through every moment and watched the case unfold. I know the full scope of it. And I can say with my whole heart: Ben McLemore is innocent. So before anyone comes at me with assumptions or judgment, know I speak from firsthand experience.

The Clackamas County jury that convicted Ben McLemore was entirely white and overwhelmingly conservative, facts that can’t be separated from the outcome. Racial bias has long shaped how Black men are perceived in the justice system, and this case was no exception.
