El 3 de julio de 1549, el emperador Carlos ordenó al Consejo de Indias que se detuvieran de inmediato todas las conquistas en América hasta que se tuviera la absoluta certeza de que los españoles estaban actuando de una forma moralmente correcta. Aquella decisión supuso un hito insólito en la historia universal. Por primera vez, una potencia hegemónica en plena fase expansiva congelaba su maquinaria bélica y administrativa por un dilema ético, obligándose a reflexionar sobre la legitimidad de su propio poder.
En ningún momento las potencias anglosajonas se plantearon un dilema de similar envergadura moral. Mientras el mundo hispánico se sumergía en un profundo examen de conciencia, el posterior avance británico y estadounidense operó bajo premisas marcadamente distintas, fundamentadas en la exclusión legal o la deshumanización de los nativos. Un claro ejemplo de esta divergencia jurídica se manifestó siglos después en Australia, donde el modelo anglosajón sostuvo que los aborígenes carecían de alma o directamente dictaminó que no existían bajo el concepto legal de tierra baldía.
Para dar respuesta a las inquietudes del emperador, se convocó un encuentro de teólogos y juristas en el Colegio de San Gregorio de Valladolid. Durante el verano de 1550 y la primavera de 1551, la ciudad se convirtió en el epicentro del debate intelectual de Europa. En aquellas sesiones participaron figuras de la talla de Domingo de Soto, Bartolomé de Carranza, Melchor Cano y Pedro de la Gasca, quienes escucharon los demoledores argumentos de dos tesis absolutamente antagónicas.
Por un lado, Juan Ginés de Sepúlveda intervino como defensor de la llamada guerra justa, utilizando la superioridad cultural europea para justificar la tutela obligatoria y la sumisión de los nativos. En el extremo opuesto, Bartolomé de las Casas ejerció una defensa visceral y apasionada de la plena humanidad de los indígenas, exigiendo el fin de los atropellos y el respeto absoluto a sus sociedades.
El dictamen final asumió la célebre tesis de Francisco de Vitoria, el eminente teólogo que había fallecido en Salamanca en 1542. Vitoria argumentaba que, habiéndose producido ya la conversión de numerosos nativos, el abandono de aquellas provincias resultaría ilícito e inconveniente para el propio bienestar y protección de los recién bautizados.
La cita textual del jurista salmantino dejó claro el camino a seguir: «Después de que se han convertido allí muchos bárbaros, ni sería conveniente ni lícito al príncipe abandonar la administración de aquellas provincias».
Bajo esta premisa de responsabilidad protectora, la Junta reconoció formalmente que los indígenas eran personas provistas de derechos propios por el mero hecho de ser hombres. A raíz de este veredicto, la Corona dictó una serie de instrucciones sumamente concretas destinadas a evitar daños y abusos sobre la población local. Fue la primera ocasión en la historia en que un pueblo conquistador establecía límites jurídicos a su propia expansión, asumiendo de forma pionera los principios embrionarios de lo que hoy conocemos como los derechos humanos.
