Excited to share my latest publication (the first from my LLM thesis) in the South African Law Journal.

In it, I try to answer such questions as ‘how can a constitution change without its text ever changing?’, ‘how are judges able to change a constitution, and is such change ever legitimate?’ and ‘when can we say a constitution has changed?’.

It contains, I hope, some insights into the nature and extent of constitutional amendment powers, constituent power in the context of interim constitutions, and the limits of judicial lawmaking. Oh, and of course there’s an entire section defending originalism as a method of constitutional interpretation. 🤭
