It was a privilege and honour to speak at the event to celebrate the 80th anniversary of Organiser.
I spoke on Jawaharlal Nehru’s First Amendment to the Constitution even before it came into effect and India had a Constituent Assembly, not an elected Parliament.
The First Amendment killed Free Speech in India because Nehru was spitefully intolerant of criticism and scrutiny; he despised the truth, especially the truth about Hindu loss, grief and degradation in Partition violence perpetrated by Jinnah’s marauders of the Muslim League.
The only paper reporting from the refugee camps and borders was the Organiser. It was told to abandon the coverage of Hindu suffering as it would ‘hurt sentiments’ in India and Pakistan!
The Delhi administration, invoking colonial law, imposed pre-publication censorship on Organiser. The publisher, Brij Bhushan went to seek relief from the magistrate’s court but the court upheld the order.
The Supreme Court struck down the censorship order in a historic ruling. The case came to be known as Brij Bhushan vs State of Delhi.
Angry and slighted, Nehru forced the First Amendment (Article 19-2) making speech conditional with restrictions, including not offending foreign states.
