Public Interest SA Calls for Immediate Suspension of IDAC Head Andrea Johnson After Madlanga Commission Testimony and Files Formal Complaint With Legal Practice Council

Public Interest SA has lodged a formal complaint with the Legal Practice Council against Advocate Andrea Johnson, Head of the Investigating Directorate Against Corruption (IDAC), following her testimony before the Madlanga Commission of Inquiry. The organisation is seeking a disciplinary investigation and has called for her immediate suspension pending the outcome of relevant investigations.

The complaint alleges that Johnson's conduct is incompatible with the ethical obligations of a legal practitioner, an officer of the court and the head of a specialised anti-corruption prosecuting body. Public Interest SA also claims that protected disclosures made by a complainant in a criminal matter involving a senior SAPS Crime Intelligence officer were unlawfully disclosed. It further notes that Johnson invoked her right against self-incrimination.

The organisation also raised concerns about the prosecution of Brigadier Dineo Mokwele and other senior SAPS Crime Intelligence officers, arguing that testimony before the Madlanga Commission casts doubt on whether the prosecution met constitutional standards of fairness, impartiality and good faith. It further referred to Johnson's previous admission that she acted unethically by failing to recuse herself from a panel that interviewed her husband, Junaid Johnson, for a position within the former Scorpions.

Public Interest SA said it will also ask the State Security Agency to review Johnson's security vetting and revoke any Top Secret security clearance where appropriate and lawful. While acknowledging that her testimony before the Madlanga Commission has not concluded, the organisation said it believes immediate precautionary measures are necessary and urged the competent authority to suspend her while the relevant processes continue.
