It wouldn't be "illegal", it would be "extra-legal" technically. Who has jurisdiction in International Waters over an unflagged vessel? Some might try to say UNCLOS, but neither the US nor Venezuela are signatories, and these "fishing vessels" are unflagged.

Blowing them up, costing the cartels, eliminating the chemicals, and scuttling the vessels are the best case scenario, if for no other reason than it makes it that much harder to recruit others to make the runs.
