WTF!! What a bulls*** stop. Flipping a cop off is clearly a free speech issue. To use that, and only that, as your reason for the traffic stop is a clear violation of his 1st amendment rights. Getting sick of cops violating people’s rights and seeing no punishment or discipline. If cops want us to trust them, they should behave on a way that fosters trust and respect.

Stolen vehicles are one of the most dangerous stops cops make. They are all trained to perform a “felony stop” in these circumstances. So by the book, all is ok. But how about showing some mature decision-making. Putting those kids in handcuffs is completely unnecessary. And then to lay them facedown on hot asphalt. Come on guys. Use some discretion. Can kids kill cops? Of course they can. But how about bringing them back, a quick pat down for weapons, and have them brought back, out of danger and stay with one of the officers. No extra officer, then place them in the car, WITHOUT handcuffs. Teenagers in handcuffs, maybe. But little kids in handcuffs is not something people are ok with. Do better.

This officer should have removed his gun from its holster just like he did. If this guy, screaming in his open window, brought a weapon to bear and if this officers gun was in his holster at the time, the officer would never be able to defend himself. This guy yelling, “why are you pulling your gun, you know me” means absolutely nothing. Nobody ever pulled a gun on a cop until they did. The male is angry, confrontational and belligerent. This officer did exactly what he should have done.

Every officer sees risk or threats differently. The officer that shot will be judged on would a reasonable officer in the same situation act similarly. It is a hard scene to watch, no doubt about that. I might have not felt the same threat level as this officer based on the subject’s movements. Sounds like this man’s crime spree was pretty crazy and may have amped up the officers working that night. I believe the officer will not have charges filed against him. The officer also has qualified immunity in this shooting. To summarize, I would not have shot this man until he made a more direct move for the gun he was carrying. But I believe this officer can and will be found to have this be a justified shooting.

I love this. I cannot articulate a crime you are committing so I will demand ID and when you refuse (even though you can refuse on a non-investigative, social contact) arrest you for obstruction. Hmmm…..Maby a little circular logic. I am sick of seeing videos of cops who do not understand the constitution or the case law on these stops. Dude should’ve just walked away and see if this clown used force to stop him.

Officer Gold instantly violated his firearms training, which says you need to identify the target before pulling the trigger. Pure murder. To me, Officer Gold looked scared and fired because he was surprised and was not expecting to see this young man running. This video is horrific. Officer Gold should face manslaughter charges immediately. And no pay while being prosecuted as he will sit at home on his Xbox for the public to pay his wages.

Here we go again. Officers, let me help you out. These guys are baiting you knowing you will most likely perform an illegal seizure, which will move onto a illegal arrest, because the guy with the camera knows more about his constitutional and state rights than the officer does. I cannot emphasize this enough to officers, nearly ALL suspicious calls like this are cash grabs (and if the violated case law was clearly established and a reasonable officer should have known this case law, you guys lose qualified immunity). Of course some suspicious calls need to be investigated but what is the officer investigating in this call. There is no underlying crime or reason the camera guy needs to ID himself so everything that takes place after the initial seizure is called fruits of the poisonous tree (if the seizure is illegal, everything that occurs after that seizure will be suppressed). Here’s the rub, if the officers perform an illegal arrest, everything after that is suppressed, what happens when they find evidence of a real crime like a dead body in the car that was searched incident to arrest (let’s not debate that one as I know the camera guy would have to be in his car for that to be valid). If they could not find a legal way to get to the body, all of this evidence would be suppressed. Ok, off my high horse. Officers, do better. Study case law because these guys have the federal and state codes memorized.

I have to say that I cannot stand when cops don’t know how case law directs their actions. Here, the citizen is completely correct when he explains to the officer that they need particularized suspicion that a crime is being committed or is about to be committed. This guy has done nothing wrong. And, as I have said before, there must be an underlying crime for obstruction or fail to identify self comes into play. Our country need better trained law enforcement officers. This stop, called a social contact, the citizen is allowed to walk away without identifying themselves if that is their inclination. Sad.
