🚨Big Law vs Transformation - Day 5 Bombshell 🔥
NADEL just dropped hard truths in the Pretoria High Court on the Legal Sector Charter.
Adv Melanie Ipser laid it bare:
The top 6 Big Law firms rake in R1-4 billion each annually.
Together? R10 billion out of the sector’s R30 billion… “and it could be more.” ‼️🧵1/...
5/..As transformation associations rightly argue: There was ZERO need for this court battle.
These issues could (and should) have been resolved through negotiation and dialogue between the parties.
Court looks like delay and resistance.
As Adv Sikhakhane put it: These white firms are double-dipping. They want briefs from both private sector and government but do not want to play by the rules.
One day we will figure out how the Iranian theocratic government became so good at trolling the US, and that too using US-style pop culture memes and lines.
3/..Then came the killer line on the applicants’ submissions:
“They say they like transformation but…”
Just like people who say:
“I’m not racist but…”
“I’m not sexist but…”
We all know what comes after the “but” - it usually cancels out the first part.
3/..Transformation is not a favour.
It is embedded in our Constitution. It is our DNA.
After decades of exclusion, Black lawyers demand real structural change - ownership, leadership, and fair briefing - not excuses dressed up as “merit” arguments.
The Legal Sector Code is voluntary.
Don’t like it? Don’t use it.
But if you operate in this country and want the benefits that come with it, comply like everyone else. No special exemptions for Big Law.

Below are high level pointers that I’m sharing from the Amicus (friend of the court) the Joburg Society of Advocates submissions in the #LegalPracticeCode matter.
The role of an Amicus is to help the court reach a decision & often they submit facts and statistics for consideration by the Court.
The submissions are brilliant sadly point to a systemic & long journey ahead in the legal profession especially with regards to transformation:
- The JSA's membership has undergone significant demographic changes over
the last three decades.
- As of late 2025, 55% of the JSA’s members are black and 39% are women, 11 compared with the overwhelming white and male Bar of the past.
However, these numbers belie the stubborn inequalities that remain at the Bar, as is evident at the level of senior counsel and in the high attrition rates among juniors.
Of the 238 senior counsel at the JSA at the end of 2025, 171 were white (71.8%),
of which 148 were white men (62.2%).
There were only 45 black silks (18.9%) of which the overwhelming majority (37) were men. There were only eight black African women senior counsel, constituting just 3.36% of all silks.
These figures illustrate that progression and retention, rather than entry, remain
the primary transformation bottlenecks at the JSA.
Attrition statistics reflect that black juniors continue to leave the Bar in greater
numbers.
Over the last 5 years, 406 junior counsel (with more than 1 year of seniority) left the JSA.
Of these members, 272 (66%) were Black junior counsel; of which 108 were Black female junior counsel.
The attrition rates amongst juniors in the first four years of practice were particularly high, with 142 juniors departing between 2020 and 2025, of which 85% were black juniors.’
