Big win for election transparency: The PA Supreme Court unanimously held yesterday that Cast Vote Records are public under the Election Code, reversing the Commonwealth Court. Schnee Legal Services filed an amicus brief in the case. CVRs let the public “check the math” on election results. Access runs through the Election Code (qualified electors), not the RTKL. #PALaw #OpenGovernment #ElectionLaw

Earlier this week, my clients filed a motion under Pennsylvania’s anti-SLAPP (Strategic Litigation Against Public Participation) statute because we believe that the Borough’s use of taxpayer dollars in order to chill my client’s constitutionally-protected First Amendment rights violates their civil rights. Additionally, the motion sets forth that my clients, as administrators of a Facebook group, are immune from any liability under Section 230 of the Communications Decency Act. A homeless veteran in Pennsylvania just reached out to me.

He was DENIED by the Mercer County Board of Elections to register to vote.

Director Thad Hall is the one that denied this homeless veteran the right to vote.

Mr. Hall also threatened to call the DA on the veteran.

I called & spoke to Mr. Hall — he hung up on me.

How is this right? How is this fair? How is this just? Is this the way Pennsylvania treats homeless veterans?

I called back & told them this was about to peacefully go viral to 1.7 million people.
