Consider the following:
In 2017 SEC issued the DAO. Then 2017-19 there were 57 enforcement actions 🆚 crypto companies, involving ICOs (#KIK, #Telegram, etc).
In 2018 we got the Hinman Speech.
In 2019 the SEC issued its Framework for Digital assets.
Also in 2019, former Chairman Clayton publicly agreed with Hinman’s speech stating the token itself is NOT a security and that a token can, at first, start out or be issued as a security, but later transform so that subsequent sales of the token no longer meet the Howey test.
Yet, FOUR years later, Amanda, Gensler and team, moved backwards regarding regulatory clarity.
#XRP provides an example (Yes, we beat Amanda, Gensler and Jorge in Court - and I’m not even a securities lawyer - 😝)
Consider the following:
In 2014 the @USGAO described #XRP as a “virtual currency utilized in a decentralized payment protocol called Ripple.”
It certainly didn’t describe it as a security.
Also consider, in 2015, FinCEN declared #XRP “convertible virtual currency” and forced Ripple to comply with U.S. Banking laws, not securities laws.
The SEC was informed (through an info sharing agreement with FinCEN) and didn’t step in and say these were also securities.
Also consider, in his speech, Hinman basically said any network that is equal to or more decentralized than #ETH isn’t a security.
Consider that Ripple wasn’t sued during those 57 prosecutions and XRP has been publicly traded for 7 1/2 years in the United States.
Now also consider what the SEC’s 2019 Framework For Digital Assets stated:
“If a token can be used as a payment or as a substitute for fiat, it is “unlikely to satisfy Howey.”
That’s the very use case for #XRP. @TapJets & @Spend_The_Bits use #XRP that way. Hell, there was an #XRPTipBot on Twitter long ago allowing p2p payments for years.
Look at what @coinbase said about XRP in 2019. 👇
Now also consider, that the 2019 FSOC annual report highlighted #XRP NOT as a security but as a “virtual currency” - a report that was signed by ALL the top financial regulators in the United States, including Clayton and Jerome Powell. 👇
Also consider in 2019 @MoneyGram filed documents w/the SEC 👇disclosing how MoneyGram would be using #XRP in its cross border payments business. The SEC knew MoneyGram would sell #XRP to the public on Coinbase - the company it approved to go public 2 years before suing it likely at the advice of Amanda.
In January 2019, Coinbase met with the SEC to inform the SEC it intended to list XRP on its platform and had decided XRP is NOT a security but wanted to make sure the SEC didn’t disagree. The SEC didn’t disagree.
But Amanda wants to pretend the market had clarity. Now you know why 75K XRP holders and an asbestos lawyer defeated the SEC in court - with Judge Torres, a lifelong democratic judge, appointed by @BarackObama, agreed with my brief and cited the affidavits I submitted.

I’m not known as a big Trump supporter. In fact, although I received over 1.3 million votes and was the first Republican candidate for U.S. Senate to get over 40% in MA in many years, my lack of support for @realDonaldTrump cost me Republican votes.
I’m sharing this now - not to revisit history - but because it provides unbiased context for me to make the following comment regarding @BarackObama’s statement below.
Despite being political opponents, it’s an absolute shame that a former American President can’t bring himself to give even the slightest amount of credit to a current American President, especially when it comes to saving tens of thousands of lives, including the lives of innocent children, many of whom are starving to death.
Trump’s critics can’t dismiss what I’m saying by claiming I’m just another Trump sycophant - which is what they usually do, even if the person is making a valid point.
As for you, President Obama, despite winning the Nobel Peace Prize ONLY 9 MONTHS into your first presidential term, peace wasn’t achieved by you or your administration.
The Nobel Peace Prize committee gave you the award based on vague references regarding your efforts to strengthen international diplomacy and cooperation - whatever that means.
But to be clear: there were roughly 7,000–9,000 strikes/missile impacts/air raid events into Gaza during your presidency. Simply put, peace did not happen under your watch, did it?
We all now know, you and others in your administration, attempted to “save democracy” by sacrificing democracy in an effort to stop Trump from becoming President. It seems, to you, the ends justified the means. But the truth is, you don’t get to call out toxic division while practicing toxic division.
Have we become so divided as a nation that you can’t bring yourself to simply say - on this one specific issue - good job President Trump?
But then again, you are the same former president who chastised fellow African-American voters if they exercised their own judgment and didn’t get in line to vote for @KamalaHarris - as you said they should - but instead, chose to vote for Trump.
So, although not known as a big Trump guy, let me say it for you Barrack - just as @JohnFetterman, a fellow
democrat of yours, said: “Good job President Trump.”
This information made public by @iampaulgrewal and @Coinbase should shock everyone involved in the long fight to force the @SECGov to be transparent in its outrageously abusive actions against crypto in the past. Don't forget that @EMPOWR_us sent its evidence referral on Hinman to the SEC in May 2022.
