According to the author Section 47.1 should not apply to @blakelively because its protections hinge on factual determinations — namely, whether she acted without malice and had a reasonable basis for her statements. Those issues have not been decided by any trier of fact (the jury) and cannot simply be presumed resolved because a defamation claim was dismissed at the pleading stage.
Notably, this is essentially the same argument advanced by the Wayfarer Defendants 🤓🤓
