Mr Sardesai it is quite literally a Judge’s job to ask all sorts of questions to ascertain the truth - much like it is a journalist’s job to ask questions (I am sure you are familiar with that concept).

Justice Prasad did nothing wrong in asking questions about the petitioners who were before him. Age is a very important fact that conveys many things about a person - which is why even in news reports a persons age is usually always mentioned.

Besides, asking questions is an age old legal principle and practice, statutorily enshrined under Section 165 (now section 168 BSA) of the erstwhile Evidence Act, which empowers judges to ask questions that might even seem irrelevant to someone :

“The Judge may, in order to discover or to obtain proper proof of relevant facts, ask any question he pleases, in any form, at any time, of any witness, or of the parties about any fact relevant or irrelevant; and may order the production of any document or thing; and neither the parties nor their agents shall be entitled to make any objection to any such question or order…”

Hence as a criminal lawyer one is flabbergasted that the lawyers appearing for Mr Das and Mr Ranka rudely interrupted the judge and questioned the relevance of the question so posed, when - instead of simply answering the questions!

Not interrupting a judge needlessly is a basic custom of legal practice - but even from an advocacy perspective, why would you needlessly be rude to a judge who is simply trying to understand the contours of the facts before him!

Arguing in court doesn’t mean literally arguing with a judge or automatically assuming that the judge is hostile to your client - be humble and answer the judges questions first and thereafter make your legal submissions - strange that these elementary principles are being ignored.

Personally in these 12-13 years, I am deeply disappointed with only one neo-politician and that is K Annamalai avl. I invested a lot of hopes on him.

He had everything going for him. Resources of mighty BJP, personal backing of Modi ji & Mota bhai, uncharted field of TN wherein BJP has nothing but to gain and rising popularity riding over the BJP chariot. He just needed to dedicate himself for 10-15 years and he would’ve been a serious contender of BJP’s next-gen top leadership team.
