FARMER SENTENCED TO LIFE IMPRISONMENT FOR THE MURDER OF FELLOW FARMER

The National Prosecuting Authority (NPA) welcomes the sentence of life imprisonment imposed by the Pretoria High Court on Fredrick Pieter Jacobus Botha (44) of Vanderbijlpark for the premeditated murder of Christiaan van Tonder. In addition to the life sentence, the court sentenced Botha to 10 years' direct imprisonment for theft of cattle; seven years' direct imprisonment for possession of an unlicensed firearm; and three years' direct imprisonment for possession of ammunition. The court ordered that the sentences for theft of cattle, possession of an unlicensed firearm, and possession of ammunition run concurrently with the sentence of life imprisonment.

On 29 November 2021, the deceased sold 31 head of cattle to Botha. After taking possession of the cattle, Botha requested that the deceased accompany him in the deceased's vehicle to a remote area near the Theoville plots in Barrage, purportedly to finalise payment for the livestock. Upon arriving at the location, Botha shot and killed the deceased while he was seated in his bakkie. Later that same day, members of the Barrage Neighbourhood Watch discovered the vehicle with the deceased's body inside and reported the matter to the police. Following extensive investigations, Botha was arrested on 29 August 2023.

During the trial, Botha pleaded not guilty to all charges and denied any involvement in the offences. However, State Prosecutor Advocate Jeniffer Cronje presented compelling evidence that proved his guilt beyond a reasonable doubt. During sentencing proceedings, Botha, through his legal representative, urged the court to deviate from imposing the prescribed minimum sentence. He submitted that four permanent employees depended on him for employment and that he provided financial support to his wife, children, mother-in-law, and father. Advocate Cronje opposed any deviation from the prescribed sentence and argued that Botha had shown no remorse for his actions and that the murder was carefully planned. Advocate Cronje submitted that the deceased had been lured to a secluded gravel road where he was murdered for financial gain. Advocate Cronje further highlighted that the deceased was a young and promising farmer whose life was cut short by a senseless act motivated by greed. In addition, the deceased's mother continues to suffer severe psychological trauma because of losing her son.

In delivering sentence, the court agreed with the State's submissions, finding that Botha had demonstrated no remorse for his conduct and that the murder had caused profound and lasting harm to the deceased's family. The court further found that Botha was not the sole provider for his children, noting that they were adequately cared for by their respective mothers. The court emphasised that murder remains one of the most serious offences that can be committed, as it reflects a blatant disregard for the sanctity of human life. The court also noted society's demand for stern sentences to deter violent crime. Furthermore, livestock theft and the possession of unlicensed firearms and ammunition remain prevalent and serious offences in South Africa. The court consequently found that no substantial and compelling circumstances existed to justify a lesser sentence and imposed the prescribed sentence of life imprisonment.

The NPA welcomes the sentence and hopes it sends a strong message that stock theft and violent crimes targeting members of the agricultural community will not be tolerated. Perpetrators can expect to face the full might of the law.

Album Review for Please Don’t Cry by Rapsody

This was a really interesting project. A Very introspective album. There are so many moments of vulnerability and clarity that it makes you really understand who Rapsody is as a person.

You feel the emotions in the tracks. The background vocals as well as the features are all amazing too. The pacing was very different between the interludes and the deep cut tracks but you still get the feeling of each track making its own statement. Her lyrics are top notch and the production was clean and mixed well. The storytelling concept of the project was so impressive because of the central theme.

This was another great piece of work from Rapsody. This is an album that you should take time outta your day and listen to for sure.
