GOMBE APC CRYING OVER A SPILT MILK

The attention of supporters and associates of @ProfIsaPantami has been drawn to the press statement issued by the Publicity Secretary of the APC in Gombe State, Amb. Moses Kyari Bolde, wherein several unfounded allegations were made regarding the resignation of Prof. Pantami from the All Progressives Congress (APC).

Ordinarily, the statement would not deserve a response, as it is largely founded on conjecture, speculation, and political sentiment rather than law. However, for the purpose of setting the records straight and preventing the public from being misled, a brief response has become necessary.

RESIGNATION FROM A POLITICAL PARTY IS A PERSONAL ACT, NOT A COLLECTIVE DECISION

The central argument advanced by the APC spokesperson is that the Ward Executive Committee did not deliberate on or receive Prof. Pantami's resignation letter. This argument betrays a fundamental misunderstanding of both constitutional law and political party administration.

Membership of a political party is voluntary. By virtue of Section 40 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), every citizen has the right to freely associate and, by necessary implication, the right to cease such association whenever he so desires.

A political party cannot compel a citizen to remain its member against his will. Such a proposition would amount to involuntary political servitude and would be contrary to the spirit and letters of the Constitution.

The law does not require a Ward Executive Committee meeting, debate, ratification, endorsement, approval, acceptance, or resolution before a member can resign from a political party. Resignation is a unilateral act which becomes effective upon communication to the appropriate authority.

In law, a resignation does not require acceptance before it takes effect. This principle has been repeatedly affirmed by Nigerian courts in relation to public and private offices and applies with equal force to voluntary associations.

THE BURDEN IS NOT ON PROF. PANTAMI TO PROVE ACCEPTANCE OF HIS RESIGNATION

The APC statement repeatedly emphasizes that the Ward Exco members did not see the resignation letter. Curiously, the same statement admits that the Ward Chairman informed members that he received the letter.

Having admitted receipt, the issue of whether every member of the executive committee physically saw the document becomes legally irrelevant.

The law recognizes delivery and receipt, not subsequent circulation.

Once a resignation letter reaches the designated party official, the legal burden shifts. The effectiveness of the resignation cannot be defeated by internal administrative lapses, deliberate suppression, or failure to convene a meeting.

No political party can retain a member merely by refusing to process his resignation.

POLITICAL RIGHTS CANNOT BE SUBJECTED TO ADMINISTRATIVE OBSTRUCTION

The position canvassed by the APC spokesperson would create an absurd precedent.

Under such reasoning, a member who resigns today could remain perpetually trapped in a political party simply because some officials decline to acknowledge, discuss, or circulate his resignation letter.

Such a position would offend the constitutional guarantee of freedom of association and would be unsustainable before any court of law.

Political parties are vehicles of democratic participation, not prisons from which members require permission to exit.

PARTY CONSTITUTIONS CANNOT OVERRIDE THE NIGERIAN CONSTITUTION

Even assuming, without conceding, that there exists any provision in the APC Constitution prescribing internal procedures for resignation, such provisions cannot override Section 40 of the Constitution of the Federal Republic of Nigeria.

The Constitution remains supreme by virtue of Section 1(1) and Section 1(3), and any rule inconsistent with it is null and void to the extent of its inconsistency.
