Vusimuzi “Cat” Matlala has withdrawn from the plea and sentence agreement related to the R228 million Medicare24 health and wellness police tender.

In effect, the plea agreement falls away and the matter starts afresh. The magistrate who rejected the plea deal will not preside over the trial, as he has already expressed views on the agreement and may be regarded as conflicted.

Matlala is expected to change his plea to “not guilty”, meaning the legal process resets and the presumption of innocence applies until a court finds otherwise. The prosecution will once again carry the burden of proving its case beyond a reasonable doubt, despite any previous admissions made during plea negotiations.

Vusimuzi Cat Matlala was dissatisfied with the additional four years imposed by the magistrate. Considering that this is a non-violent offence, the practical impact of those extra years may have been significantly reduced through parole provisions. If that was the motivation behind withdrawing from the agreement, it appears to be a risky gamble.

The case now heads back to square one, with a full trial likely to determine Matlala’s fate.
