The proposed Kenya Robotics and Artificial Intelligence Society Bill 2023 has faced significant criticism for several reasons. Here are five main concerns:
1️⃣ Heavy Penalties for Non-Compliance: The bill proposes significant fines (up to KES 1 million or approximately $6,250) and potential prison sentences of up to two years for entities operating without a license.
2⃣ Increased Bureaucracy and Regulatory Burden:
By creating the Kenya Robotics and Artificial Intelligence Society with extensive regulatory powers, the bill introduces additional bureaucratic hurdles. Companies will need to navigate complex regulatory requirements and potentially deal with increased operational costs to comply with the new regulations
3️⃣ Focus on Control Rather than Support: The bill appears to prioritize regulatory control and the creation of new bureaucratic structures over providing support and resources for professionals. This focus could result in a regulatory environment that is more punitive than supportive, making it harder for professionals to thrive
4️⃣ Inhibiting Self-Taught Professionals: The bill's emphasis on formal registration and licensing could marginalize self-taught professionals and those without formal degrees. This approach risks excluding a significant portion of the workforce that has gained expertise through non-traditional educational pathways, potentially stifling innovation and reducing the available talent pool
5️⃣ Lack of Framework for Ethical and Legal Issues: The bill does not adequately address important ethical and legal issues related to AI, such as data privacy, algorithmic transparency, and accountability. Professionals in the field may find themselves navigating a regulatory landscape that lacks clear guidelines on these critical matters, leading to potential legal risks and ethical dilemmas
