The SEC asked for $2B, and the Court reduced their demand by ~94% recognizing that they had overplayed their hand. We respect the Court’s decision and have clarity to continue growing our company.
This is a victory for Ripple, the industry and the rule of law. The SEC’s headwinds against the whole of the XRP community are gone.
The SEC plans to ask the Judge for $2B in a case that involved no allegations (let alone findings) of fraud or recklessness. There is absolutely no precedent for this. We will continue to expose the SEC for what they are when we respond to this.
Our response will be filed next month, but as we all have seen time and again, this is a regulator that trades in statements that are false, mischaracterized and designed to mislead. They stayed true to form here. 2/4
Gensler’s SEC has repeatedly acted outside the law – not going unnoticed by Judges admonishing the agency for a "gross abuse of the power entrusted to it by Congress" (DEBT Box case) and for acting without "faithful allegiance to the law" (Ripple case). Let’s not also forget Gensler’s lack of attention to SBFraud.

This is 💯 and is very consistent with recent case law handed down by the Supreme Court and the 2nd Circuit Court of Appeals, requiring disgorgement of profits to be tied to the actual harm of investors. When there is no harm, why force a company to incur $100M or more in legal defense costs.
After spending millions, the SEC secured a $130K fine against @LBRYcom and the legals fees bankrupted LBRY, costing real human jobs.
After Ripple had paid $150-$200M in legal fees what if the SEC can’t prove harm?

Even before you consider the gross appearances of impropriety and massive conflicts of interests, or the SEC Ethics emails directing Hinman to stop violating the financial criminal conflict statute (which he continued to violate, as proven by his own SEC emails), just being the friend of the regulator can equate to being off the hook.
@ethereumJoseph understood this better than anyone and that’s why he hired Clayton’s law firm Sullivan & Cromwell to represent him and @Consensys.
Clayton asked Hinman to reach out to Lubin and Consensys. Between December 13, 2017 and June 8, 2018, Hinman had multiple documented meetings (a minimum of 4) with Lubin, @VitalikButerin, and the Consensys team. Clayton even inquired about the meetings, asking Hinman how the meetings were going. Those are indisputable facts. Of all the meetings the Director of Corporation Finance was having, Clayton inquired, more than once, on the ETH/Consensys meetings. 🤔
In his internal SEC email, Hinman referred to his speech as the “Ether Speech.” He didn’t call it the “Bitcoin and Ether Speech” or the “When Gary met Howey (Palstic) Speech” - only the “Ether speech.
Even without considering the profit-sharing Hinman was getting equalling $15M from a law firm that was a member of the EEA, or the SEC Ethics department warning Hinman to stop it (which he ignored), or that Hinman met with his law firm’s China partner regarding the Canaan IPO (which was before Hinman’s division), or that he now works for the same folks that helped write his speech, and without considering that Clayton voted for an enforcement action against his law firm’s client’s biggest competitor, the statement below highlights the scenario we’ve witnessed play out.
We need to enforce conflict laws and we need to close down the revolving 🚪 at the @SECGov for good.
