UPDATE: @katibainstitute has filed an urgent Petition Challenging Proposed Establishment of Ebola Quarantine Facilities in Kenya

The petition, filed under a certificate of urgency through Counsel @joshuamalidzo, is brought against the Attorney-General and the Cabinet Secretary for Health.

Katiba Institute is seeking urgent court intervention to stop the establishment and operationalisation of any Ebola quarantine or treatment facility in Kenya under any arrangement involving the United States or other foreign governments.

Among the urgent orders sought, @katibainstitute wants the Court to:

• Restrain the Government from establishing or approving any Ebola quarantine or treatment facility pending hearing and determination of the case.

• Bar the Government and its agents from receiving, transferring, or facilitating the entry into Kenya of persons exposed to or infected with Ebola under the alleged arrangement.

• Compel the Ministry of Health to present, within 24 hours, a comprehensive national contingency plan detailing Kenya’s preparedness, surveillance, prevention, control, and response measures for any potential Ebola outbreak.

The petition raises concerns around public participation, transparency, accountability, public health preparedness, and constitutional oversight.
