Tim Cruz’s statements after the Lindsay Clancy mistrial should raise serious concerns regardless of which side of this case you are on.
Lindsay Clancy was not convicted. There was no guilty verdict. The jury did not resolve criminal responsibility. The case ended in a mistrial, and Cruz himself said his office had not yet decided whether to retry her.
Then he told the media
“The facts are Lindsay Clancy killed her three children.”
“She was in control of her actions.”
“Cruel and calculated killing.”
“Heinous killings.”
“Insensitive is killing three children.”
That is not the same as saying, “The Commonwealth’s position was that the evidence proved criminal responsibility.”
Mass. R. Prof. C. 3.6 prohibits extrajudicial statements a lawyer knows or reasonably should know have a substantial likelihood of materially prejudicing an adjudicative proceeding.
Rule 3.8 places an additional duty on prosecutors to refrain from statements that have a substantial likelihood of heightening public condemnation of the accused, except where necessary to inform the public about legitimate prosecutorial action.
So what legitimate prosecutorial purpose was served by publicly declaring Lindsay was “in control” and calling the killings “cruel and calculated” while another trial was still being considered?
That is the issue.
People are deeply divided over Lindsay Clancy, but your personal view of her is irrelevant to whether her right to a fair trial must be protected.
If you hate her, it should still concern you.
If you support her, it should still concern you. Due process does not depend on whether a defendant is popular.
A mistrial is not a conviction. A prosecution theory is not a judicial finding. And disputed issues that may have to be decided by another jury should not be publicly presented as though they have already been adjudicated.
Does this automatically mean discipline or bar retrial? No. But are there legitimate concerns under Rules 3.6 and 3.8? Absolutely.
If we only care about fair trial protections when we like the defendant, then we do not actually care about fair trial protections.
