#CCC investigated Zambia Airways on whether it had engaged in unconscionable conduct by refusing to reroute passengers to their destinations and provide them with accommodation and meals in Lusaka. The investigation resulted from reports that a Zambia Airways flight had delayed to depart from Livingstone to Lusaka for over 6 hours resulting in 4 passengers missing their connection flights to other destinations. It was alleged that Zambia Airways informed the passengers that it was unable to facilitate their reconnection or provide them with accommodation. Thus, the passengers were forced to find ways to rebook connecting flights and secure own meals and accommodation in Lusaka. #18September2025#CCC has published a decision on #Uber's Terms & Conditions following an investigation to determine whether the Terms were false & misleading, and unconscionable
This investigation was in response to consumer complaints received with regard to Uber’s services in #Uganda, #Kenya and #Egypt. The complaints alleged, among others, that consumers were being charged higher prices than the displayed price; drivers were cancelling the booking after a long waiting period; drivers were failing to turn up yet customers would still be charged.
#CCC reviewed Uber’s Terms and Conditions to investigate these allegations and determine whether they were compliant with the COMESA Competition Regulations. Uber had an opportunity to respond to the concerns raised by the consumers and recommendations of the CCC. Uber cooperated in amendment of their Terms and Conditions. CEO-CCC Dr Mwemba participating in the panel session on "the intersection between Competition Law and consumer welfare".
Dr Mwemba highlighted that the #CCC is in the process of amending the COMESA Competition Regulations to reflect consumer protection in its name. He observed that there are fragmented consumer laws at the national level which creates difficulty in coordination of enforcement against consumer violations. He informed the participants that the #CCC through its #COMESA Consumer Protection Committee has thus developed a consumer model law which will guide on the development and harmonisation of consumer laws in the 21 COMESA Member States.
