अगर आप दो पहिया, चार पहिया या अन्य कमर्शियल वाहन के चालक हैं तो रोड पर वाहन चलाते समय अपने निम्नांकित अधिकारों की जानकारी आपको होनी चाहिए,

• कोई भी ट्रैफिक पुलिसकर्मी न तो आपके साथ मारपीट कर सकता हैं एवं ना ही गाली दे सकता हैं। साथ ही आपको अनावश्यक रूप से परेशान भी नहीं कर सकता एवं न ही पैसे की मांग भी कर सकता हैं। अगर कोई ट्रैफिक पुलिसकर्मी ऐसा करता हैं तो इसकी शिकायत वरिष्ठ पुलिस अधिकारी, पुलिस हेल्पलाइन एवं क्षेत्रीय पुलिस थानें में लिखित रूप से अवश्य करें।

• अगर सड़क पर ट्रैफिक पुलिस आपको रोककर कागजात दिखाने की मांग करती है तो आप साफ तौर पर मना कर सकते हैं। इतना ही नहीं आप उसकी शिकायत सीनियर अथॉरिटी से भी कर सकते हैं। ट्रैफिक कानून के मुताबिक, एक एसआई या उससे ऊंचे पद के अधिकारी को ही आपके कागजात मांगने का अधिकार है।

• किसी भी ट्रैफिक पुलिस को आपको गिरफ्तार करने या आपका वाहन जब्त करने का अधिकार नहीं है। बल्कि वह पॉल्यूशन अंडर कंट्रोल पेपर्स (पीएसयू) की मांग नहीं कर सकता क्योंकि यह अधिकार केवल आरटीओ अधिकारियों का है। यदि आप किसी यातायात कानून का उल्लंघन करते हैं तो कांस्टेबल को आपके वाहन से चाबी छीनने का कोई अधिकार नहीं है।

• ट्रैफिक कानून का उल्लंघन करने पर केवल सब-इंस्पेक्टर (वन स्टार), सब-इंस्पेक्टर (टू-स्टार) और पुलिस इंस्पेक्टर (थ्री-स्टार) ही आपसे जुर्माना वसूल सकते हैं। (भारतीय मोटर-वाहन अधिनियम, धारा 132)

• अगर आपने सिग्नल तोड़ा है, सीट की छमता से ज्यादा लोग गाड़ी में बैठे हैं, माल ढोने वाली गाड़ी में सवारियां भर रखी हैं, शराब पीकर या नशे की हालत में गाड़ी चला रहें हैं, मोबाइल पर बात करते या फिर तेज रफ्तार में गाड़ी चलाते पकड़े जाने की स्थिति में ट्रैफिक पुलिस को आपका लाइसेंस जब्त करने का अधिकार है।

• अगर आप ट्रैफिक कानून का उल्लंघन करते हुए पकड़े जाते हैं तो आप पर जुर्माना लगाया जाता है। लेकिन इससे अधिक 100 रुपये आप पर लगाना केवल एक एसआई या एसआई का अधिकार है। हेड कांस्टेबल आप पर 100 रुपये से अधिक जुर्माना नहीं लगा सकता है और कांस्टेबल को आप पर जुर्माना लगाने का कोई अधिकार नहीं है।

• अगर कोई ट्रैफिक पुलिस बिना ड्रेस पहने आपका चालान काटती है तो उसे ऐसा करने का कोई अधिकार नहीं है। एक बात आपको जाननी चाहिए कि कांस्टेबल से लेकर एसआई तक सफेद रंग की पोशाक पहनते हैं, और ट्रैफिक इंस्पेक्टर और उच्च पद के अधिकारी खाकी पोशाक पहनते हैं।

• वाहन चलाते समय अपना वाहन पंजीकरण प्रमाणपत्र (आरसी), बीमा प्रमाणपत्र और प्रदूषण नियंत्रण प्रमाणपत्र (पीएसयू) और ड्राइविंग लाइसेंस हमेशा अपने पास रखें। एक बात आपको पता होनी चाहिए कि चेकिंग के दौरान डिजी लॉकर के डॉक्यूमेंट्स भी ऑरिजनल के तरह मान्य होंगे।

• किसी विशेष परिस्थित को छोड़कर ट्रैफिक पुलिस को आपको अरेस्ट करने या आपके वाहन को जब्त करने का अधिकार नहीं है।

• अगर आपने गर्दन से ऊपर यानी कान या किसी अन्य जगह पर सर्जरी कराई है या आप पगड़ी पहनने वाले सिख समुदाय से हैं तो आपके लिए हेलमेट पहनना अनिवार्य नहीं है।
