Wer den Grenzzaun überwindet oder die Exklave schwimmend erreicht, befindet sich daher zwar auf spanischem und europäischem Hoheitsgebiet, erhält dadurch aber kein automatisches Recht auf freie Weiterreise innerhalb des Schengen-Raums.
Die einfache schnelle Rücküberstellung nach Marokko ist laut Urteil des spanischen Gerichtshofs nicht möglich bei Personen die Ceuta schwimmend über das Wasser erreicht haben. Viele bleiben zunächst in den Exklaven und müssen später kontrolliert aufs spanische Kern-Festland weiterverlegt werden. Die Aufnahmeplätze in Ceuta mit 562 Plätzen sind drastisch überfüllt.
