🛠Tortle Ninja | July 19, 2023 Hotfix Release:

Today, we deployed a hotfix to solve two issues that we detected.

✅The first issue is related to the data we obtain from BeethovenX. We had to upgrade the way in which we obtain the data to version 3 because the previous version seems to be completely deprecated.

✅The second issue we encountered was related to the gas needed to execute a transaction. Specifically, we were experiencing an "underpriced transaction" issue. This means that the gas limit set for a transaction was lower than the amount required to execute it. After performing some tests, we adjusted the amount of gas and gasPrice used to send the transaction, which resolved the issue.

It's worth noting that during periods of high congestion on the #Fantom network, the underpriced transaction error is more likely to occur.

However, to address this, Tortle includes a “Retry” system to allow users to run transactions even if the first attempt fails.

👀Angespannt blickt die Krypto-Branche auf den US-Senat. Dort wird über einen Gesetzentwurf zur strengeren Regulierung des DeFi-Bereichs verhandelt. Das Gesetz nimmt Betreiber von DeFi-Protokollen in die Pflicht, sie sollen die Einhaltung von Geldwäschevorschriften kontrollieren. Brisant ist das daher, weil es solche Verantwortlichkeiten im Bereich dezentraler Finanzen typischerweise nicht gibt. Die Vorschläge des Entwurfs stoßen auf Kritik.

‖DeFi-Bereich im Visier‖

📜Kontrollpflichten, wie sie auch für Banken gelten: Der “Crypto-Asset National Security Enhancement Act of 2023” soll Regeln für den Finanzmarkt auf den DeFi-Bereich ausweiten. Konkret geht es um die “Anwendbarkeit von Sanktionen und Verpflichtungen zur Einhaltung von Geldwäschebestimmungen auf US-Personen im Bereich der dezentralen Finanztechnologie”. Der Entwurf wird überparteilich von Demokraten und Republikanern vorangetrieben.

Mit dem Gesetz sollen Geldwäscheschlupflöcher geschlossen, der “Anstieg der Krypto-Kriminalität” bekämpft werden, wie es in einem Briefing-Dokument heißt, aus dem Coindesk zitiert. Auch von Sanktionsmaßnahmen ist die Rede. Deren Umsetzung wäre eine Belastungsprobe für DeFi-Protokolle.

‖Wer ist haftbar?‖

🤖DeFi-Geschäfte laufen automatisiert, mithilfe sogenannter Smart Contracts. Betreiber gibt es somit nicht. Auf irgendwen müssen die Gesetze aber angewandt werden. Dem Entwurf nach sind das Personen, “die ein DeFi-Protokoll kontrollieren oder eine Anwendung zur Nutzung des Protokolls zur Verfügung stellen”. Somit könnten Entwickler in den Fokus rücken, die etwa Benutzeroberflächen bauen.

Andernfalls könnten auch Investoren betroffen sein. “Wenn niemand ein DeFi-Protokoll kontrolliert, dann ist – als Absicherung – jeder, der mehr als 25 Millionen US-Dollar in die Entwicklung des Protokolls investiert, für diese Verpflichtungen verantwortlich”, heißt es in dem Dokument.

Diese Kontrollinstanzen müssten Kunden überprüfen, Daten erheben, Antigeldwäscherichtlinien einhalten, verdächtige Aktivitäten melden und sanktionierte Personen von der Protokollnutzung ausschließen.

‖DeFi-GAU?‖

❌In seiner jetzigen Form wäre das Gesetz ein Rückschlag für die DeFi-Branche. Anwendungen sind so entwickelt worden, dass es eben keine direkten Verantwortlichen gibt. Da sich auch Entwickler haftbar machen, könnten die Auflagen zu einem schleichenden DeFi-Sterben in den USA führen.

Ähnliche Vorgaben, wie sie mit dem Data Act auf EU-Ebene durchgesetzt werden sollen, werden kontrovers diskutiert. Auch hier wird ein De-Facto-Verbot von Smart-Contract-Anwendungen befürchtet.
