He replied: There is no problem with doing so, as long as one does not intend to specifically designate this time, believing that there is a special virtue in reciting them at this particular time.

For it is mentioned in the two Sahihs: “Whoever recites them during a night.” Whoever recites them when going to sleep has indeed recited them during a night.

The prescribed time for reciting them begins from the start of the night, and this time is better than other times, so that it will suffice for him and he will attain the virtue from the beginning of the night.

Views of the Scholars on the Difference Between Fardh and Wājib.

Shaykh Sālih Āl al-Shaykh said:

“...Imām Ahmad and a group of the people of knowledge held that the fardh is greater than the wājib, from the aspect that what Allāh, Exalted is He, made obligatory is called fardh, and what the Sunnah indicated its obligation is called wājib, except when it comes with the wording of fardh. Therefore, the distinction between the fardh and the wājib is from the aspect of the evidence, not from the aspect of rank. So, they are, from the aspect of the legally obligated ruling, one thing, their ruling is obligation, the fardh is wājib and the wājib is fardh. However, what is from the aspect of the evidence from the Qur’ān is called fardh, and what is from the aspect of the evidence from the Sunnah is called wājib.

And some of the people of knowledge said: The fardh is a higher degree than the wājib, and this is what is well known from the madhhab of Abū Hanīfah, may Allāh have mercy on him. For the fardh according to him is what is established by definitive evidence, and the wājib is what is established by non-definitive evidence. So, according to him, there is a distinction between the fardh and the wājib in terms of the evidence for it and in terms of its rank, so the fardh according to him is higher than the wājib.

And according to the first opinion, the fardh and the wājib are one thing in terms of rank, but they are different in terms of establishment.

And a group of the people of knowledge said, and it is the opinion of the majority, that the fardh and the wājib are one in terms of the evidence for them and in terms of rank. So it is said: the five prayers are farā’idh, and it is said: they are wājib, and it is said: the fasting of Ramadān is wājib, and it is said: fardh, and it is said: Hajj is wājib and fardh, and it is said: dutifulness to parents is wājib and fardh … and so on, according to this third opinion, which is the known, famous opinion, because the farā’idh and the wājibāt, their meaning is one, so the fardh means the wājib.”
