A widow was owed ₹75 lakh on her husband's HDFC Life policy. The insurer rejected the claim, alleging he'd suppressed material facts when he bought it.
But the policy had crossed three years.
There's a line in the Insurance Act, Section 45: that most policyholders never learn until they need it: once a life policy has been in force for three years, the insurer can no longer question it for non-disclosure. The only exception is proven fraud. And "we suspect" is not "we've proven."
HDFC Life couldn't prove fraud. The UP State Commission ruled for the widow. The NCDRC agreed and dismissed the appeal.
Three years of a policy staying alive isn't just three years of premiums. It's a legal shield quietly clicking into place.
