Sabi sa Article XI, Section 3(6) ng 1987 Constitution: “The Senate shall have the sole power to try and decide all cases of impeachment. xxx When the President of the Philippines is on trial, the Chief Justice of the Supreme Court shall preside, but shall not vote.”

Ang turo sa kahit anong law school: kung malinaw ang Constitution, hindi na kailangan ng interpretation. Kung may ambiguity, saka maaaring tingnan ang records ng Constitutional Commission.

Ang tanong: may ambiguity ba? Wala.

Malinaw ang Constitution. Kapag ang Pangulo ang nililitis, ang Chief Justice ang magpe-preside. Sa impeachment trial ng ibang impeachable officers, silent ang Constitution kung sino ang dapat mag-preside. Ngunit ang silence ay hindi automatic ambiguity. At lalong hindi ito automatic prohibition.

Kaya kung may ibang Senador na mag-preside maliban sa Senate President, anong probisyon sa 1987 Constitution ang tahasang nilabag? Wala.

Kung napag-usapan man noon sa Constitutional Commission na ang Senate President ang magpe-preside, ang mahalagang tanong ay ito: bakit hindi iyon isinulat sa mismong text ng Constitution?

Hindi lahat ng napag-usapan sa deliberations ay controlling. Kung iyon talaga ang mandatory rule, dapat iyon ang isinulat.

Kung walang express constitutional prohibition, may kapangyarihan ang Senado na magpasya kung paano nito gagampanan ang constitutional duty to try and decide impeachment cases. Ang mahalaga, hindi nito nilalabag ang malinaw na utos ng Constitution at nananatiling tapat sa layunin ng impeachment: ang panagutin ang public officers.
