@meinmokhtar Nak buang penjawat awam ni bukan senang. Banyak paperwork dan banyak investigation. Keputusan juga akan ambil masa. Salah satu proses cacat maka gagalkan keadilan. Penjawat awam ni pun boleh datang balik kalau dia rasa improper termination. Sebab tu semua proses ambil masa lama.

No bro. Some fathers spend their monies on their family first and never for his own needs. My dad worked for 40 years. Made a lot of money. Gave us everything. He wore the SAME shoes for 25 years. His Bally shoes from 1982 is still at wearable. Never splurge for himself. An old school father who put family first. Now I am a father, I also don't buy anything for myself. Wife and kid first. I'm copying my Babah.

What Do Players Need to Prove Unilateral Contract Termination by Clubs?
The FIFA DRC in FPSD-16846, Mark Herold Goulon v. Johor Darul Ta’zim Football Club, addressed a dispute where the player alleged unilateral contract termination by the club, emphasizing the necessity for players to provide robust evidence to substantiate such claims before the DRC.
The facts of the case reveal that on May 9, 2022, Mark Herold Goulon entered into an employment contract with Johor Darul Ta’zim Football Club effective from January 1, 2023, to November 30, 2023. The contract stipulated a monthly salary of $15,000, a sign-on fee of $15,000, a monthly house allowance of MYR 3,000, 4 economic flight tickets; and a car for personal use.
Goulon alleged that the club failed to provide a flight ticket to Malaysia, forcing him to cover the cost himself. Upon arrival, he claimed he was denied access to the club, prevented from training, and informed orally by the club’s manager on January 20, 2023, that the club would not execute or register the contract with the Football Association of Malaysia (FAM), advising him to seek a new club. Goulon further stated that his repeated requests to be integrated into the club’s activities in January 2023 were denied, and the club did not provide written confirmation of the termination despite his requests.
On February 1, 2023, Goulon signed a new contract with Negeri Sembilan Football Club in Malaysia, valid until December 17, 2023, for a monthly salary of $9,000 and a monthly payment of MYR 2,500 for transportation and accommodation, which he was responsible for arranging.
On October 20, 2024, Goulon filed a claim with FIFA, seeking MYR 20,000,000 as compensation for breach of contract, arguing that Clause 9.4 and Schedule C of the contract, described as a “release clause,” served as a pre-determined compensation mechanism for early termination by either party. Alternatively, he claimed $180,000 ($165,000 for salaries from January to November 2023, $15,000 sign-on fee) and MYR 33,000 (house allowance for January to November 2023) as the residual value of the contract, plus $90,000 for egregious circumstances, including the club’s failure to register the contract, exclusion from training, and pressure to find a new club without payment. He contended that the club unilaterally terminated the contract without just cause on January 20, 2023.
The club did not respond to the claim despite being invited to do so, leaving the DRC to decide based on the player’s submissions and available evidence, per Article 21, paragraph 1 of the Regulations.
On the merits, the DRC found that Goulon failed to provide adequate evidence of the club’s unilateral termination. He submitted no proof of payment for the flight ticket, exclusion from club activities, or the alleged oral termination on January 20, 2023. The DRC emphasized that players MUST present concrete evidence, such as written correspondence, payment receipts, or documented communications, to substantiate claims of non-performance by the club. Despite acknowledging the contract’s validity, the DRC determined that Goulon did not meet the burden of proof under Article 13, paragraph 5 to establish a breach of contract, as his allegations lacked supporting documentation.
Notably, the DRC clarified that the FAILURE TO RECEIVE ONE MONTH’S SALARY, AS OCCURRED IN JANUARY 2023, DOES NOT AUTOMATICALLY CONSTITUTE UNILATERAL CONTRACT TERMINATION, as termination requires evidence of explicit or implicit actions by the club to end the contract. Consequently, the DRC rejected Goulon’s claim for compensation for breach of contract, including the MYR 20,000,000 under the release clause and the alternative $180,000 plus MYR 33,000.
However, the DRC upheld the principle of pacta sunt servanda, noting that the contract was effective from January 1, 2023, until Goulon signed with Negeri Sembilan on February 1, 2023, and the club provided no evidence of compliance with its financial obligations. Thus, the DRC awarded Goulon outstanding remuneration for January 2023: $15,000 (monthly salary), $15,000 (sign-on fee), and MYR 3,000 (house allowance).
This ruling clarified that while clubs are bound by contractual financial obligations, players must substantiate claims of unilateral termination with robust evidence of non-performance, such as documented communications or proof of exclusion, to secure compensation beyond outstanding remuneration. It further established that the non-payment of a single month’s salary does not equate to unilateral termination without additional evidence of the club’s intent to end the contract. The minimum is non – payment of at least two monthly salaries on their due dates.
One major lesson I learnt while reading this is the critical importance of advising players to meticulously document all communications and actions related to contract disputes to meet the burden of proof required by FIFA’s Procedural Rules.
Respect your partner more than you love them. Love can exist while you’re still causing damage, but respect makes you pause. When you truly respect someone, you think before you act and consider how your choices impact them.
