As a banker, you should appreciate that numbers are only useful when the underlying assumptions are correct.

So where is your mathematics?

Start with the last election: 9 August 2022.

1st year: 9 Aug 2022 – 8 Aug 2023
2nd year: 9 Aug 2023 – 8 Aug 2024
3rd year: 9 Aug 2024 – 8 Aug 2025
4th year: 9 Aug 2025 – 8 Aug 2026
5th year: 9 Aug 2026 – 8 Aug 2027

Now calculate the dates.

Second Tuesday of August 2026 = 11 August 2026.
That is Day 3 of the fifth year.

Second Tuesday of August 2027 = 10 August 2027.
The fifth year ended on 8 August 2027. Therefore, 10 August 2027 is Day 2 of the sixth year.

So before telling lawyers they are poor at mathematics, show us your mathematics. Where exactly does your calculation place 11 August 2026?

Numbers do not become 2027 simply because you expect them to.

When we tell Kenyans that Safina Party consistently puts Kenya’s interests first, there should be no doubt.

We have been at the forefront of defending the Constitution, including insisting that elections must be held in the fifth year, as provided by the Constitution and now affirmed in the recent judicial determination.

But our constitutional advocacy is only one part of the fight. Safina has also consistently confronted Kenya’s odious debt problem ; the borrowing that has choked our economy, narrowed our fiscal space and left ordinary Kenyans carrying an ever-growing burden through taxes, deductions and declining purchasing power.

Kenyans must now distinguish between those seeking genuine transformation and those merely seeking admission into a political system that has extracted from this country for six decades while giving too little back to its people.

Safina is not fighting to inherit a broken system. We are fighting to dismantle the culture of impunity, restore constitutional government, audit the debt, protect public resources and put Kenya’s interests first.

The choice before Kenyans is becoming clearer: those who want to preserve the system, and those prepared to change it.

If Article 136(2)(a) mandates that the presidential election be held on the second Tuesday of August in every fifth year following the last election, how can anyone claim that the incumbent must first complete five full years from the date of swearing-in before an election can lawfully be held?

Are we interpreting the Constitution, or rewriting it to accommodate political timelines?

Look carefully at the wording. Article 136(2)(a) does not say “five years after the President is sworn in.” It establishes an election cycle tied to the last election and specifies the second Tuesday of August in the fifth year.

The law is the law. It does not matter for how long the law has been violated. Article 138(1) & (2) of the Constitution, on the Procedure at presidential election, categorically provides:
(1) If only one candidate for President is nominated, that candidate shall be declared elected.
(2) If two or more candidates for President are nominated, an election shall be held in each constituency.
Voting at elections is conducted as provided under Article 86, which provides:

86. At every election, the Independent Electoral and Boundaries
Commission shall ensure that-

(a) whatever voting method is used, the system is simple, accurate, verifiable, secure, accountable and transparent;

(b) the votes cast are counted, tabulated and the results announced promptly by the presiding officer at each polling station;

(c) the results from the polling stations are openly and accurately collated and promptly announced by the returning officer; and (d) appropriate structures and mechanisms to eliminate electoral malpractice are put in place, including the safekeeping of election materials.

From the law above, there is no way the results for the Presidential elections cannot be announced at the Constituency as required by the Constitution. #ReKe #GetitDone #KnowYourConstitution
