A federal appeals court just ruled that possessing AI-generated child sexual abuse material is protected by the First Amendment — and the judges who issued the ruling are openly warning the Supreme Court that its 25-year-old precedent may no longer hold up in the age of artificial intelligence.
The Seventh Circuit said it was bound by the Supreme Court's 2002 decision in Ashcroft v. Free Speech Coalition, which held that sexually explicit images of fictional children couldn't be restricted when no real child was involved in their creation. But the judges stressed that AI has fundamentally changed the equation: generated images are now virtually indistinguishable from real abuse material.
The case involves Steven Anderegg, who investigators say had hundreds of AI-generated sexually explicit images depicting children on devices seized from his Wisconsin home. His possession charge was dismissed on First Amendment grounds, while three other charges — producing, distributing, and transferring the material to a minor — remain intact.
