Federal Court reiterates that unlike with misrepresentation in the immigration context, misrepresentation for citizenship revocation purposes requires an intention to decieve. This intent can manifest as either a direct intention to mislead, willful blindness, or recklessness.
Willful blindness imputes knowledge to someone whose suspicion is aroused to the point where they see the need for further inquiries but deliberately choose not to make those inquiries. This means that if the Defendant had any suspicion about the contents of the documents and chose not to read them to avoid knowing the truth, it could be considered willful blindness.
For recklessness to be established, there must be evidence that the Defendant was aware of the risk or danger of signing the documents without understanding their contents and still proceeded.
