I thank the Hon’ble Supreme Court for upholding the rule of law, and @DrAMSinghvi along with the AICC Law Department for their timely and steadfast interventions. For the second time, Dr Singhvi & his sharp team - @lawyerkhanmd & Omar Hoda - have defended my liberty amid sustained threats & intimidation by the Assam CM.

I am deeply grateful to Smt Sonia Gandhi, Shri Mallikarjun @kharge, Shri @RahulGandhi, Smt @priyankagandhi, Shri @kcvenugopalmp, and Shri @Jairam_Ramesh for their unwavering support and encouragement.

Finally, I thank the millions of @INCIndia supporters who stood by me with their voices and prayers.

My bail is not only a personal victory and a source of relief, but also a reminder to those who misuse state power that as long as we remain a Constitutional Democracy, personal liberty cannot be sacrificed for political vendetta.

भूमि अधिग्रहण कानून का पूरा मसौदा हमने राहुल जी को दिखाया, उसमें मुआवजा और पुनर्वास के प्रावधान दिखाए।

राहुल जी ने एक ही सवाल पूछा- इसमें उनके लिए क्या है, जिनकी जमीन जा चुकी है।

सेक्शन 24(2) के माध्यम से लाखों लोगों को उ��की जमीन वापस मिली।

पिछले 10 साल में हर कांग्रेसी एक परीक्षा से गुजरा है, इस परीक्षा में जो सफल हुए हैं, वो दो क्वालिटी के साथ उभर कर आए हैं- पहला निडरता और दूसरा जिद्दीपन।

बात तीन महीना पुरानी है।

7 फरवरी , 2025 को @RahulGandhi ने, @supriya_sule और @rautsanjay61 के साथ एक प्रेस कांफ्रेंस की थी। उसमें महाराष्ट्र चुनाव में वोटर लिस्ट की अनियमितता और चुनावी प्रक्रिया पर डेटा प्रस्तुत किया और चुनाव आयोग से कुछ सवाल पूछे थे।

प्रेस कांफ्रेंस के कुछ ही मिनट बाद चुनाव आयोग ने वक्तव्य जारी किया कि वो जल्दी ही तथ्यों के साथ राहुल जी की बातों का ज��ाब देंगे।

चुनाव आयोग ने उस दिन हैडलाइन बना दी।

लेकिन वो दिन है और आज का दिन है। चुनाव आयोग ने कोई तथ्य नहीं दिए, कोई जवाब नहीं दिया। बस वायदा किया और फिर उसे भूल गए।

उस दिन से अब तक, चार महीनों में कांग्रेस पार्टी ने कई बार केंद्रीय चुनाव आयोग से मिलने का वक्त मांगा। लेकिन वक्त नहीं मिला।

इस बीच दिल्ली हाई कोर्ट में कांग्रेस की तरफ़ से @rssurjewala ने अर्जी लगाई और वोटर लिस्ट की कॉपी की माँग की। 25 फ़��वरी, 2025 को चुनाव आयोग ने हाई कोर्ट में कहा कि वो तीन महीने में इस बारे में फ़ैसला लेगा।

इसके बाद इसी साल 20 मार्च और 17 अप्रैल को @rssurjewala , @lawyerkhanmd और @omarhoda46 कांग्रेस के प्रतिनिधियों को महाराष्ट्र के मुख्य चुनाव अधिकारी से मीटिंग के लिए बुलाया गया । वहाँ भी कांग्रेस ने वोटर लिस्ट की इलेक्ट्रॉनिक डेटा की माँग दोहराई।

लेकिन 22 मई को दिए जवाब में मुख्य चुनाव अधिकारी ने केवल नियमों और प्रक्रियाओं का हवाला ��िया। ये नहीं बताया कि वोटर लिस्ट का डेटा क्यों नहीं दिया जा सकता । न ही ये बताया कि लोकसभा चुनाव के बाद वोटरों की संख्या में अचानक इतना बड़ा उछाल कैसे आया।

चुनाव आयोग बार बार कहता है कि सब पार्टियों को चुनाव के पहले पूरी वोटर लिस्ट दी जाती है। इसलिए दोबारा देने की ज़रूरत नहीं है। अब अगर दोबारा चाहिए तो बूथवार जो लिस्ट चुनाव आयोग की वेबसाइट पर है, उसे डाउनलोड कर सकते हैं।

चुनाव आयोग के इस स्टैंड पर हमें दिक���कत है।

कारण:

1. जब तक इलेक्ट्रॉनिक डेटा बेस फॉर्मेट में सभी वोटर लिस्ट नहीं दी जायेंगी, तक तक कोई भी विश्लेषण संभव नहीं है।

2. बूथ वार जो लिस्ट वेबसाइट पर उपलब्ध है, वो अलग अलग है। महाराष्ट्र में एक लाख से ज़्यादा बूथ थे। हर बूथ पर 30-40 पन्ने की वोटर लिस्ट होती है।

3. चुनाव आयोग कहता है कि एक चुनाव के 30-40 लाख पन्ने की वोटर लिस्ट डाउन लोड करो।

4. महाराष्ट्र के विश्लेषण के लिए 2019 और 2024 के विधान सभा चुना�� और 2024 के लोकसभा चुनाव की वोटर लिस्ट भी चाहिए।

5. इसलिए करीब सवा करोड़ पन्ने डाउनलोड करने होंगे, फिर उसे OCR तकनीक से डेटा में बदलो, फिर विश्लेषण हो सकेगा।

6. अगर ऐसा कर भी लें, तो सभी जानते हैं की OCR तकनीक से 100 % परिणाम संभव नहीं है। इसलिए चुनाव आयोग की सलाह अनुसार सही विश्लेषण हो ही नहीं सकता है।

7. चुनाव आयोग यह भी कहता है कि वह सभी पार्टियों को चुनाव से पहले वोटर लिस्ट देता है। ये सही है। लेकिन चुनाव आयोग को समझना होगा कि राजनैतिक दल और उम्मीदवार वो वोटर लिस्ट ��पने पास नहीं रखते हैं।

8. महाराष्ट्र में एक लाख बूथ पर वो वोटर लिस्ट पहुंचाई गई थी।उसी लिस्ट का वोटिंग के दिन राजनैतिक कार्यकर्ता इस्तेमाल करते हैं। वोटिंग ख़त्म होते होते ये पन्ने फट जाते हैं, इधर उधर हो जाते हैं।

9. किसी भी पार्टी में ऐसा कोई सिस्टम नहीं होता है कि एक लाख बूथ से शाम को वोटर लिस्ट इकट्ठा कर के मुंबई पार्टी ऑफिस में पहुंचाई जाए। ये न संभव है, ना ही इसका कोई औचित्य है।

10. इसी तर�� पाँच साल पहले हुई विधान सभा चुनाव और पिछले साल के लोक सभा चुनाव की वोटर लिस्ट हर बूथ से अब ��ैसे एकत्र की जा सकती है।

यही कारण है कि राहुल जी और कांग्रेस पार्टी केंद्रीय चुनाव आयोग से इलेक्ट्रॉनिक डेटाबेस फॉर्मेट में वोटर लिस्ट देने की माँग कर रहे हैं। चुनाव आयोग के कंप्यूटर में ये डेटा मौजूद है और तुरंत दिया जा सकता है।

अब सवाल ये है कि चुनाव आयोग वोटर लिस्ट का डेटा देने से क्यों कतरा रहा है?

चुनाव आयोग विश्लेषण करने की राह में रोड़े क्यों अटका रहा है?

ऐसा क्या है जिसे छुपाने की कोशिश की जा रही है?

कोर्ट के आदेश बाद भी चुनाव आयोग बूथ की वीडियोग्राफी देने का विरोध क्यों कर रहा है? क्यों उसने इस बारे में कोर्ट के फैसले के बाद नियम बदल दिए?

क्यों ECI कांग्रेस के प्रतिनिधियों से मिलना नहीं चाहता और चार महीने से वक्त नहीं दे रहा है?

यही सवाल आज राहुल जी ने अपने लेख में पूछे हैं।

लोकतंत्र के हित में इनके जवाब देश को मिलने चाहिए।

Mr @Jairam_Ramesh ji and I write in today’s @the_hindu about the dubious legal backing for the NRC.

Our contention; Contrary to what @AmitShah suggests, there is absolutely no legal compulsion to visit an arbitrary ‘’Assam style’ NRC on the rest of the nation.
