@MonicaPowevt4@InAnIntWorld@SheepleSuk@NBCNews it means what it says... a person born or naturalized here, and subject to US jurisdiction, is a citizen. it leads with that because 14A was establishing a constitutional rule of national citizenship after the civil war (and overturning dred scott)
@MonicaPowevt4@InAnIntWorld@SheepleSuk@NBCNews section 2 deliberately says representation is based on the “whole number of persons” in each state, while using “citizens” separately later in the same paragraph.
the amendment repeatedly distinguishes between "person" and "citizen" and is very clear in that regard.
@MonicaPowevt4@InAnIntWorld@SheepleSuk@NBCNews because section 1 does not define “person.” it says that persons who are born or naturalized here are citizens. that defines citizenship.
the same section then says no state may deprive “any person” of due process or equal protection — not “any citizen.”
@MonicaPowevt4@InAnIntWorld@SheepleSuk@NBCNews yes, it's an important distinction. that's why 14A section 2 states that we apportion representatives based on "...the whole number of PERSONS in each State..." as opposed to the number of citizens. that's why this proposed change would be unconstitutional...
@MonicaPowevt4@InAnIntWorld@SheepleSuk@NBCNews you need a refresher 🇺🇸
“all persons born or naturalized in the united states… are citizens”
“nor shall any state … deprive any person of life, liberty, or property … nor deny to any person within its jurisdiction the equal protection of the laws.”
