The Court has mistaken a border for a people. That is the central error of today’s birthright citizenship decision.

The majority treats citizenship as if it follows automatically from the physical event of birth inside American territory. But the American constitutional tradition has never understood citizenship as a mere fact of location. It has understood citizenship as a legal and political bond between a person and a sovereign people and that was true at the Founding.

The Constitution gave Congress power to establish a uniform rule of naturalization because citizenship could not be left to accident, confusion, or local manipulation. Hamilton wrote in Federalist 32 that a uniform rule had to be national because citizenship defines membership in the nation itself. Madison made the same point in Federalist 42, criticizing the Articles of Confederation for allowing loose state rules to convert alien inhabitants into citizens with rights across the Union.

The Founders did not think citizenship was a border trick. They treated it as a matter of sovereign judgment.

The Fourteenth Amendment did not erase that premise. It was adopted to repudiate Dred Scott and secure citizenship for freedmen who were born here, lived under American authority, owed no allegiance to a foreign power, and had been wrongfully excluded from the American people.

That is why the text does not stop at birth. It requires birth in the United States and subjection to the jurisdiction thereof.

The majority makes that second requirement nearly useless. It says jurisdiction means little more than being subject to American law while present here. But everyone inside the country is subject to American law in that sense. Tourists are. Foreign students are. Temporary workers are. Unlawful entrants are. That proves the government has territorial power over them. It does not prove they have entered the political relation of allegiance and membership.

Thomas and Alito, as usual, got it right. The phrase “subject to the jurisdiction” was not idle drafting. It preserved the distinction between presence and belonging, between control and allegiance, between being governed while here and being incorporated into the people of the United States.

The majority collapses all of that. It imports the broadest version of English subjecthood, strips it from the American founding, runs it through Reconstruction, and then declares the result constitutionally inevitable. Ridiculous.

Dred Scott denied citizenship to those who were already part of the American people. Today’s Court commits the opposite error by treating constitutional membership as a consequence of mere territorial birth.

Citizenship is not a hospital record. It is not a souvenir of geography. It is not created by crossing a border and giving birth.

Citizenship is allegiance, protection, obligation, and membership in a sovereign people.

The majority forgot the people.

Spirit Airlines died tonight at the hands of the socialist crusader, Elizabeth Warren

She must be so proud to add another casket to her achievements.

Tonight at 3am, Spirit turns off the lights. 14,000 jobs gone. 30+ smaller airports lose service.

JetBlue offered $3.8 BILLION in cash to buy Spirit in 2022. Shareholders, flight attendants union, literally everyone voted yes.

The combined company would have held 9% of the US market against a Big 4 that already owned 80%.

For anyone who understands numbers: 9% isn’t a monopoly against 80%.

Warren said no.

She wrote letters. She pressured Buttigieg. Biden’s DOJ sued. A federal judge killed the deal in January 2024.

Her argument: the merger would cost consumers $1 billion a year.

Now look at her collateral damage she dusts under the rug.

510 pilots gone in the months after. 1,800 flight attendants furloughed in December.

14,000 jobs in 2023. 7,500 last week. Zero tonight.

And that’s just the people in Spirit uniforms.

Catering goes. Fuel guys go. Baggage crews, gate agents, airport coffee shops, hotels and rental cars in 70 cities Spirit flew to. Every airline job carries 3 more on its back.

40,000 people out of work because of one woman’s moronic crusade against the market.

And the math ain’t mathing.

Spirit abandoned 90 routes during the death spiral. Fares on those routes are up 14% on average. Oakland to Newark: $135 to $288. Fort Myers to San Juan: $92 to $219. Kansas City to Newark up 66%.

That’s reality. Not some BS number from a “study.”

So @SenWarren tell me how this saves the consumer money?

Cheap carriers in a market drop fares 21% across the board. Southwest did this in the 90s and saved Americans $68 BILLION over 20 years.

Warren killed it. That’s what moronic politicians led by socialism do.

Then with her own blind arrogance, she tweeted Spirit’s collapse is “a Biden win for flyers.”

A win.
