Judge Boasberg of All People Just Handed Trump a Welfare Data Win in 22 Blue States - Pants on Fire News:
Judge James Boasberg once ordered Trump's deportation flights turned around while the planes were still in the air.
Twenty-two Democrat-led states walked into his courtroom expecting him to block Trump on welfare records.
They walked out with a loss and two words from the bench they won't want read back to them.
Blue States Tried to Stop DHS From Seeing Welfare Records
The fight is over the Temporary Assistance for Needy Families program – better known as welfare.
Under a new Administration for Children and Families policy, the Department of Homeland Security and other federal agencies can now see TANF files.
In the Federal Register, the administration said the point is to stop fraud and confirm recipients meet program rules – immigration status included.
That's not a radical idea.
That's making sure taxpayer money goes to people legally entitled to it.
California Attorney General Rob Bonta led the lawsuit alongside New York and D.C., filing on August 3 in federal court in Washington.
In the end, 22 states, the governors of Kentucky and Pennsylvania, and the District of Columbia signed on.
Their argument boiled down to this: if immigrant families know DHS can see their welfare file, some might stop signing up.
That's not an argument against fraud.
That's an argument against checking at all.
The White House saw it the same way.
"Democrats are once again admitting that their top priority is ensuring illegal immigrants can receive taxpayer-funded benefits meant for American citizens," White House spokesman Kush Desai said when the suit was filed.
The Judge Called Their Case Vague and Their Costs Self-Inflicted
Boasberg, the chief judge of the U.S. District Court for D.C., denied the states' request for emergency relief.
He found they failed to show irreparable harm and had serious problems proving standing.
The states brought sworn statements from state officials predicting people would drop out.
They didn't bring one from an actual TANF recipient saying so, or any real numbers to back it up.
"Rather than identifying government statements showing an intent to target immigrants, Plaintiffs proffer vague, unsubstantiated predictions," Boasberg wrote, according to Bloomberg Law.
Vague and unsubstantiated.
Then he went after their money argument.
The states claimed they'd get stuck with costs from notifying residents about the data sharing.
Boasberg called those costs "self-inflicted" – because the states' disclosure laws created them, not Washington.
When even Boasberg won't give blue states an emergency order against Trump, they brought a thin case to court.
A separate advocacy group lawsuit over the same policy also lost before a federal judge in New York.
The policy was cleared to take effect September 30.
Bill Clinton Signed the Reporting Rule in 1996
Sharing welfare information with immigration authorities isn't a Trump invention.
Section 404 of the 1996 welfare reform law – signed by Bill Clinton – says each state receiving federal grants "shall, at least 4 times annually and upon request," furnish immigration authorities with the name and address of anyone the state knows is unlawfully in the United States.
For years, Washington read that rule so narrowly it barely mattered.
A 1998 Justice Department opinion said it only applied to the specific state agency running the program.
On September 1, the Justice Department's Office of Legal Counsel threw that reading out.
The new opinion says "State" means the whole state, so any state agency that knows someone is here illegally is covered under TANF and SSI.
So the blue states aren't fighting some new Trump overreach.
They're fighting a law their own party's president signed.
Sixteen Billion Dollars and Bonta Wants No Questions Asked
States and D.C. collected nearly $16.5 billion in TANF block grants in fiscal 2024, according to Congressional Research Service figures cited by Nextgov.
That's federal money, paid for by taxpayers in Ohio, Texas, and Florida as much as California.
Bonta and his allies want the checks to keep flowing while Washington is told to look the other way on who's cashing them.
The case isn't over, and the states can keep fighting on the merits.
But every week this policy runs, DHS gets a clearer look at who is collecting from a program meant for struggling American families.
And Rob Bonta just lost his best shot at keeping those files closed.
