Today, the Biden admin filed a notice of appeal of the Texas Medical Association decision. I'm not at all surprised - DOJ has vigorously defended the rule in other court cases. The appeal is to the 5th Circuit...but I bet we get a final rule before much appellate action. 1/2

And while our Insurance Department has worked with our dated and inadequate network adequacy laws, it can’t change a pig into a prince. The #NBPP2023 with refined time/distance AND wait time standards is a huge advancement.

This is critical (and often overlooked). As health plans change and narrow networks, patients need stronger, more responsive #NetworkAdequacy protections, which were gutted in recent years. Regulators need to be as dynamic as the Marketplace they regulate. #NBPP2023
