FHA and other types of financing have stricter condo approval requirements for developments of 5+ units. HOA's with 4 units or less are exempt from most of these requirements and if the units are fully detached, they can be considered a "site condo"... which gives it a more streamlined condo approval for financing purposes.
My public comment submitted in response to @MayorToddGloria ADU revisions: "As one of the Champions for AB1033, I'm excited to see you considering the implementation of AB 1033 to enable condo conversion of properties with Accessory Dwelling Units (ADUs) as part of this package. This is an opportunity to unlock a pipeline of affordable homeownership options, and I support the concept if the proposal is amended to address key concerns.
1) I am alarmed that the proposal lacks any mechanism to prioritize owner-occupant buyers. Without explicit buyer-occupant preference, investor buyers will dominate the market, purchase attractive ADU condos, and absorb inventory, undermining the law's intent to benefit occupant-homeowners. I urge the Commission to incorporate a 45 day first-right-of-refusal (not deed-restriction, triggering financing problems) protecting primary residence buyers from being outbid by investors. https://t.co/TnaDmVKhmK
2) Additionally, I'm concerned about financing challenges for projects with more than four total units. These developments may be ineligible for conventional financing, leaving buyers with limited finance options. I recommend exploring mitigation measures to ensure that larger ADU condo conversions remain fully financeable and don't inadvertently lock out prospective homeowners. (ie-Conventional, VA or FHA approval) With these amendments, AB 1033 can deliver on its promise of affordable homeownership for San Diegans currently locked out of homeownership. "
San Diego has a number of policy options for how to make it easier for homeowners to build small-scale ADUs. An important one is to allow ADUs to be sold separately from the main unit. That can help homeowners recoup their investments early, & create needed homes for purchase.

2/2 undocumented immigrants that are able to purchase a home are likely entrepreneurs. They also likely contribute jobs to our economy and pay taxes through an ITIN....because just like everyone else in America, documented income (or ability to service debt) is required to qualify for a mortgage
