“Is there ANY law that allows deregistration of a political party?”

That was the central question inside the Delhi High Court today, as a PIL sought the deregistration of the Aam Aadmi Party and disqualification of Arvind Kejriwal, Manish Sisodia, and Durgesh Pathak from contesting elections.

The petitioner argued that leaders who “scandalise the judiciary” and allegedly lose faith in constitutional institutions violate Section 29A(5) of the Representation of the People Act.

But the Bench pushed back repeatedly:
• Even if an individual faces contempt proceedings, does that automatically disqualify them from elections?
• Can conduct of office bearers lead to deregistration of an entire political party?
• Where exactly is the statutory power for deregistration?
The Court reminded the petitioner that the Supreme Court has already held that the Election Commission has NO general power to deregister a political party after registration — except in extremely narrow circumstances.
At one point, the Bench directly observed:
“Your matter does not fall in any of those exceptions.”
What began as a political controversy quickly turned into a constitutional debate on free speech, contempt law, electoral disqualification, and the limits of judicial power.

Big question now:
Can criticism of courts ever become a ground to remove a political party from India’s electoral system?
