GST on ice creams are now open to interpretation as @cbic_india circular 164/20/2021 is not conclusive.
Ice cream parlours on @swiggy_in & @zomato are charging GST at 5%, 18%, 0%, no-GST. Utter confusion for everyone involved. This industry needs some clarity. @GST_Council
@GodrejAgrovet I am a small farmer from Tanjore dt. Tamilnadu cultivating oil palm for the last 20 years. I am deeply disappointed that your company staff are not helpful . They notify harvest dates about 4 days before, but do not respond to sending the trained harvesters.
GST Council regularizes GST charged @ 5% without ITC on the supply of ice-cream by ice-cream parlours during the period 1.07.2017 to 5.10.2021 to avoid unnecessary litigation.

Clarity on retrospective applicablity is paramount. Hope we also get a clarity on the differential treatment on sale of ice creams in Restaurants (5%) vs Ice Cream Parlours (18%) @GST_Council@cbic_india#icecreamGST#GST#icecream
The GST Council is likely to take up the issue related with the levy mechanism on ice cream parlour. Ice cream companies have urged for clarification on the applicability of GST at the rate of 18 per cent on parlour. https://t.co/sgvCnnY0SZ
@IndiaToday@Rahulshrivstv Ice cream parlours are classified under Service Tax and FSSAI as 'Restaurants'. GST Act did introduce a new category for ice cream parlours. Retrospective charge will kill many businesses who've already lost 2 summers due lockdown.
@FinMinIndia@GST_Council please consider.
@IndiaToday@Rahulshrivstv "Parlour owners are liable for 18% GST for the past supplies with effect from July 1, 2017. This would drive most of us to bankruptcy"
Ground reality, the entire 13% has to be shelled out from owner's pockets, with interest. Cannot recover past ITC or collect from customers.
Ice cream parlour owners have sent a petition to the Finance Ministry, seeking clarity, after receiving tax summons from #GST authorities

Can ice cream parlours who function like a restaurant, preparing ice creams sundaes in kitchens for table service, on glassware with various toppings, in an air-conditioned setting, allowed to charge 5% GST?
@cbic_india@GST_Council@FinMinIndia
@cbic_india@GST_Council We sincerely hope you consider levy of 18% GST on ice creams prospectively. Also, wrt. sale of ice cream, please treat Restaurants and Ice Cream Parlors equally under law. #Article14@iicmaiicma@sudhirscoops
@business_today What is the implication for normal restaurants who sell manufactured ice creams along with food, are they also expected to charge 18% GST for ice cream related offerings? #IceCreamGST

Will there be a difference between ice cream served at Restaurants vs. Ice Cream Parlours?
@EconomicTimes So what happens to existing rulings by Authority of Advance Rulings (AARs) on this subject? Telangana AAR has ruled that ice cream parlours are ‘eating joints’ and supply of ice cream is to be treated as ‘restaurant service’. #IceCreamGST
Telangana AAR has ruled that ice cream parlours are ‘eating joints’ and supply of ice cream is to be treated as ‘restaurant service’ at 5% GST rate. Are these rulings overruled wrt. to Circular No. 164/20/2021-GST?

@gsthelpline This means Ice Cream parlours that sell already manufactured ice creams are goods sellers. In that case are they allowed to opt for 'GST Composition Scheme' if turnover is below 1.5Cr? #IceCreamGST
