Supreme Court Ignores Science, Uses Old Law in Maintenance Case

In a recent case, a woman and her child asked for financial support from a man she said was the father. However, the Supreme Court refused to help, relying on an old law called the "presumption of legitimacy." This law assumes that a child born during a marriage is the husband’s responsibility, even if there’s proof saying otherwise.

Why This is a Problem?

This might seem like a win for the man in this case, but it could lead to bigger issues.

In the future, if a husband says a child isn’t his, courts might use the same logic to force him to pay anyway. This could create unfair situations for many families.

This decision reminds me of the Joseph Shine v. Union of India case, which made adultery legal.

I worry this new ruling might encourage married women to have affairs, knowing they can still claim financial support from husband.

If you love a man & don't have iota of empathy, respect and honour for his parents who brought him up and made him who he is, then that love is quite shallow

Parents weeping to just hold the medal in their hands which their son received for his bravery and keep it for sometime isn't a herculean demand.

A lover/wife would hold the memories more precious than a medal. She may move on as well to start a new life. For parents the medal for their son is the only honour for rest of their life.

To slam the parents for having this little expectation is sign of a society where nothing stands above rights of a woman or a wife even if she denies to herself stand by basic human values.

I feel sad if we have become that society.
