Madurai, Tamil Nadu | Madurai District Court pronounced a sentence in the Sathankulam custodial death case. The case falls under the rarest of rare categories. All nine policemen get the death penalty.

Advocate Jaba Singh, representing the victims, says, "The court has delivered a landmark judgment, awarding the death penalty to the accused from A1 to A9. The first accused (A1) has been ordered to pay a compensation of Rs 24 lakh. The second accused (A2) has been directed to pay Rs 16.30 lakh. In total, a compensation of Rs 1.40 crore must be paid to the mother of the deceased, Bennix. The court also stated that if the accused fails to pay the compensation, their properties will be confiscated and sold, and the amount will be given to the victim’s family"

He is Kurubara Suresh, a labourer in Karnataka's Kodagu. His wife, Mallige, went missing in 2021.

Suresh filed a missing report, but the police registered a murder case against him after skeletal remains of a woman were found within their jurisdiction. He was coerced into confessing to the murder of his wife and jailed.

He spent 18 months in custody before a court-ordered DNA test confirmed the remains weren’t of his wife, Mallige. He was granted bail.

Even 1½ years after his release on bail, villagers, relatives, and even his two teenage kids still believed he had killed his wife. No one believed his pleas until his friends spotted Mallige alive, having lunch with her boyfriend, Ganesh, at a hotel on April 1 this year.

After Mallige was found, the Sessions Court acquitted Suresh and ordered the Karnataka Govt to pay ₹1 lakh as compensation. Lol! Just ₹1 lakh for 18 months of jail and the irreparable mental, financial, and social trauma.

Suresh has filed an application seeking action against the investigating officer, ₹5 crore in compensation, and for court records to reflect him as a “victim” rather than “accused.”

When doctors, CAs, engineers, etc., make mistakes, they face civil and criminal penalties. Why doesn't the same apply to police and judges? Why was the man arrested without a DNA test on the skeleton? Why was the test ordered so late? Isn’t that negligence? And why should the state pay instead of the individuals responsible?
