A stalker who sent hundreds of messages to Jung Eun-ji of the girl group Apink and followed her on a motorcycle or went to her house has been given a suspended prison sentence.
According to the legal community on the 18th, Judge Lee Yong-je of the Seoul Central District Court's Criminal 13th Division sentenced Ms. Cho (59), a woman in her fifties charged with violating the Act on the Punishment of Stalking Crimes, to one year in prison with a two-year suspended sentence. She was also ordered to pay a fine of 100,000 won, undergo probation, perform 120 hours of community service, and attend 40 hours of lectures to prevent repeat stalking offenses.
Cho's stalking began in March 2020. She sent food to Jung Eun-ji with a message asking, “Would you accept me as your housekeeper or companion?” In May of the same year, she followed Jung Eun-ji on a motorcycle from Yeouido to a hair and makeup shop in Cheongdam-dong.
In April and July 2021, Cho was found to have been lurking and waiting at Jung Eun-ji's apartment. In July, while waiting at Jung Eun-ji's home, Cho was warned by the police. She then sent a message to an official at Jung Eun-ji's agency, saying, “I will not text again.”
However, Cho continued her stalking behavior by sending Jung Eun-ji about 544 Instagram Direct Messages (DMs) and messages through the paid communication service Bubble over the course of five months. The messages included content like, “Eunji (Jung Eun-ji's nickname), did you sue me? Why? I'm only texting now.”
In December 2021, Jung Eun-ji announced the discontinuation of Bubble. At that time, she said, “I thought it was a comfortable way to communicate with fans, but there seem to be some people who are overly immersed and make everyday life impossible,” adding, “Some fans cross the line of protection and come to specific places directly. I unintentionally received a lot of stress because of these things.”
The court stated, “The defendant’s messages went beyond the scope of what a fan would normally send to a celebrity in terms of support, interest, and affection,” and “Even though the victim joined Instagram and Bubble to communicate with the public, it cannot be assumed that she consented or permitted any form of approach or contact.” The court also noted that “the victim appears to have suffered significant mental shock, pain, anxiety, and fear, yet the defendant denied the crime and showed no signs of remorse.”
