IT IS TIME!

Having prepared war crimes cases myself I understand the difficulties and hard work that must go into the preparation of a serious war crimes arrest warrant application.

My own investigation has gathered sufficient evidence to support a prima facie allegation of war crimes against Israel’s political and military leadership and some rank and file soldiers as well as those complicit in those crimes.

We have shared some of that evidence with the ICC and domestic law enforcement agencies. We will continue to prepare our evidence and continue to share it and use it to bring accountability where we can.

For those that criticise us we are not a State and we are not a part of the framework established by the international community of States to protect and defend international law.

We are just regular people doing the job that States and institutions are failing to do. We have tiny resources and the task for us is huge. The personal risk cannot be understated.

Despite this we will continue to endeavour and I apologise to the Palestinians who we have failed and for who it is already too late and to those that consider our efforts to be insufficient.

So far I have repeatedly defended the International Criminal Court while many have criticised it for delaying its investigation and delaying taking the action that the world so badly thirsts for.

What Israel has done in Gaza has isolated it from the international community and it is now considered by many to be a pariah State. Even the United Nations has finally passed a vote ordering a ceasefire after months of failure and abusive veto use.

The path to peace is now and has always been equality before the law and accountability for violating it.

This applies to Palestinians and to Israelis, to the occupied and the occupier, to the oppressed and the oppressor.

The rule of law must be absolute and justice must not be curtailed or denied.

Taking hostages is a war crime. Collective punishment, the targeting of civilians, and civilian infrastructure including hospitals, schools and places of worship and the use of starvation as a weapon are war crimes.

If you show intention to destroy a people or a part of a people based on their nationality or religion the war crime is called Genocide.

Millions have been displaced, tens of thousands killed, hundreds of thousands injured and a whole people placed on the brink of starvation.

And yet there is more to come. We are on the precipice of witnessing Israel make the biggest mistake of any nation in our modern history. It has already violated the binding Security Council resolution to immediately stop hostilities. This is clear breach of international law. Breaches of a Security Council resolution are serious and can even be been used to justify third state military intervention.

I don’t agree with making comparisons to the Nazis or the holocaust because every catastrophe visited on the oppressed is unique and deserves its own recognition and chapter in history.

What makes this chapter worse than any previous chapter is that it is happening right now in real time in front of all of us beamed onto our phones and TVs - we see it, we have tools to prevent it but not the will and so it continues.

We have truly become people of the enlightened darkness where our profound knowledge has been rendered meaningless.

The International Criminal Court has the power to stop Israel.

Karim, by issuing an arrest warrant for war crimes in Palestine and Israel you can make it clear that we will not tolerate war crimes whoever perpetrated them. That our values are real and that all human life is precious and we will act to protect it - be it Israeli or Palestinian, Christian, Muslim or Jewish.

We cannot afford to delay any longer.
