@Anais_Anais_A@m4xim1l1an@Osint613 legitimate ruses deceive about military matters (location, strength, intentions, etc.) without abusing legal protections granted by IHL. Pretending to be a doctor abuses a specific legal protection (medical status), which is why it is classified as perfidy
@Anais_Anais_A@m4xim1l1an@Osint613 A ruse of war was like the British putting fake documents on a body in the North Sea to make Germany think d-day was happening elsewhere. Dressing up as doctors or other protected people is not considered a “ruse of war”.
@Anais_Anais_A@m4xim1l1an@Osint613 I don’t think you understand what it means to be “taking part in hostilities”. Membership in a resistance group alone is not “taking part in hostilities”.
@Anais_Anais_A@m4xim1l1an@Osint613 Basel Al-Ghazawi was also hors de combat as he was militarily incapacitated due to wounds, so killing him at all was a war crime.
@Anais_Anais_A@m4xim1l1an@Osint613 No it doesn't. Any use of doctors uniforms by an armed force is against the laws of war. Doctors and such are specially protected. It would have been legal to dress up as Hamas or PIJ members, but it was not legal to dress up as doctors.
@Anais_Anais_A@m4xim1l1an@Osint613 The IDF literally dressed up as doctors and civilians to attack the hospital. There are literally videos of them doing it.
@Anais_Anais_A@m4xim1l1an@Osint613 They don’t need to be recognizable as militants because they weren’t engaged in hostilities. IDF members not on active duty or on leave don’t wear their uniforms either bud.
@Anais_Anais_A@m4xim1l1an@Osint613 No they weren’t. One was hospitalized and the other two were his brothers visiting him in hospital and acting as his caretakers. There is no evidence it was being used for militant purposes. The three weren’t even all part of the same resistance organization.
@Anais_Anais_A@m4xim1l1an@Osint613 They weren’t disguised, they weren’t active combatants at that time. They were not engaging in hostilities. One of them was receiving care and the other two were his brothers. It’s no different than an IDF soldier being in a hospital in Tel Aviv recovering from injuries.
@Anais_Anais_A@m4xim1l1an@Osint613 They weren’t disguised as patients. One was literally paralyzed and injured from an IDF strike and the other two were his brothers who were acting as his caretakers and are allowed to be with their family member patient.
@Anais_Anais_A@m4xim1l1an@Osint613 They didn’t though one was a patient who was hospitalized long term after being injured in an Israeli strike and the other two were his brothers who were acting as his caretakers/keeping him company in hospital. That is not “using the hospital as a safe haven to carry out attacks”
@Anais_Anais_A@m4xim1l1an@Osint613 From your very source. This falls under section c under perfidy. Dressing up as a doctor does not fall under “camouflage” under the Ruses of war heading.
