Some observations—
Observations have no meaning when they are never implemented.
The gyan given by the Supreme Court about preventing the misuse of criminal laws by implicating distant relatives in matrimonial cases sounds great.
But if the Supreme Court is so concerned, then why not start taking action against the lower-level magistrates and police officers who allow or put the names of distant relatives into FIRs without proper basis?
Why should a husband and his relatives have to spend lakhs of rupees, travel to the Supreme Court, and file quash petitions just to get their names removed?
Why should the victim of a wrongly registered case bear the financial and legal burden of correcting someone else’s mistake?
If the Supreme Court itself keeps observing this problem again and again, then why is the system not fixing it at the point where the problem actually begins?
Or is the entire process just another way to create more business?
