Just when it appeared that an India–US trade deal was nearing the finish line, India has introduced a powerful new condition that could fundamentally reshape the negotiations. India is now pushing for a "Sunset Clause", a built-in review mechanism designed to protect Indian interests if the United States changes its trade policies after the agreement is signed.
The demand reflects a growing concern in New Delhi over the unpredictability of American trade policy. Over the past year, tariff announcements, revisions, suspensions, and legal challenges in the US have created significant uncertainty for global exporters. India's position is straightforward: a trade agreement cannot be based solely on promises when tariff policies can change overnight.
A Sunset Clause would ensure that if US alters its tariff framework or market-access commitments in the future, both countries would be required to return to the negotiating table and reassess the terms of the deal. In effect, India is seeking insurance against future policy shocks rather than locking itself into an agreement that could become disadvantageous later.
The move is inspired by recent trade arrangements involving the European Union, which also sought stronger safeguards against sudden policy changes. By demanding a similar mechanism, India is signalling that any trade deal must be based on reciprocity, predictability, and long-term stability.
For Indian exporters, the clause could provide greater certainty and reduce the risk of sudden disruptions. For negotiators, it significantly strengthens India's bargaining position by ensuring that market access remains a two-way street.
The message from New Delhi is clear: India is willing to sign a trade deal with the United States—but not at any cost. In an era of tariff wars, economic nationalism, and rapidly shifting trade rules, India wants guarantees, not just assurances. And with Commerce Minister Piyush Goyal leading the negotiations, Washington is discovering that the world's fastest-growing major economy is no longer negotiating from a position of weakness.
